Sudan Issuance Date: 10/15/2012 Closing Date: 11/12/2012 SOLICITATION NUMBER: PSC-12-078-INL SUBJECT A solicitation for a Personal Services Contractor (PSC), Department of State (DOS), Bureau for International Narcotics and Law Enforcement Affairs (INL) The United States Government (USG), represented by the DOS, seeks applications from US citizens interested in providing PSC services as described in this solicitation. POSITION TITLE: Deputy Justice Sector Advisor, Juba, S. Sudan 6. MARKET VALUE: $53,003 - $96,061 (FS-04 to FS-03 Equivalent) 7. PERIOD OF PERFORMANCE: One year from date of award and four option years 7. PLACE OF PERFORMANCE: Juba, South Soudan 8. JOB DESCRIPTION: See below STATEMENT OF DUTIES GENERAL STATEMENT OF THE PURPOSE OF THIS CONTRACT AND RESPONSIBILITIES OF THE CONTRACTOR A. BACKGROUND. The Bureau of International Narcotics and Law Enforcement Affairs (INL) is part of the Under Secretariat for Civilian Security, Democracy, and Human Rights (J) within the Department of State (DOS). INL's mission is to minimize the impact of international crime and illegal drugs on the United States and its citizens through providing effective foreign assistance and through fostering global cooperation. INL's Office of Africa and the Middle East (AME) develops and manages criminal justice sector reform programs and contributes to policy formation on civilian security issues in both regions. INL/AME and INL personnel in-country administer all U.S. government assistance to the criminal justice sector within the Government of Southern Sudan (GoSS), including its police, justice institutions, and prisons service. The goal of this program is to support nascent South Sudanese institutions to provide security and justice as public services to the population of South Sudan. The incumbent will reside in Juba and travel and work in the field occasionally, as circumstances dictate and allow. B. PURPOSE. The purpose of this Personal Services Contract is to fill the new position of Deputy Justice Sector Program Officer, whose incumbent would help oversee all management aspects of the program (to include training, funding, equipment accountability, and implementer performance). The incumbent would also provide internal control and accountability for the delivery of equipment, technical assistance, training and other assistance to the GoSS and other entities within South Sudan. The Deputy must be able to work rapidly, responding promptly to multiple demands and juggle constantly changing priorities in a difficult and demanding environment. The position requires the ability to determine swiftly what needs to be done, when it needs to be done, and how it can be delivered with enough supervision to ensure its effectiveness. Relationship: The Deputy will report to the Justice Sector Program Officer, often referred to as the INL Director. The Deputy will focus primarily on development and management of programs and related issues, with the Director providing general administrative and policy direction concerning overall program priorities and objectives. The Deputy will liaise with other agencies/ governments active in the fields of rule of law and administration of justice, as well as with host government contacts; specific activities frequently will originate from these liaison activities. The Deputy will exercise independent judgment in developing new and improved approaches to analyze and review INL programs throughout South Sudan, noting new and unforeseen opportunities as circumstances evolve. The Deputy will present these approaches to the Director for approval. 1. Serves as acting INL Director when the Director is absent. 2. Other duties, as required. D. DUTIES AND RESPONSIBILITIES: Substantive 3. Advises the INL Director on law enforcement, justice sector, rule of law, and corrections efforts. Identifies potential program efforts and areas of development for future programs that will fulfill INL's goals and objectives. 4. Evaluates and advises the Mission on the performance of South Sudanese agencies and implementing partners operating in conjunction with INL assets and resources to evaluate and recommend the need for future programs. 5. Participates with South Sudanese officials in determining how to best develop institutions that contribute to a more just society, including the police, the judiciary, the corrections system, and civil society. Generates support for and actively advances U.S. policy objectives with key GoSS officials, influential organizations, the media, and leaders in the private sector. 6. Liaises with and assists the various South Sudanese law enforcement agencies in developing viable capacity-building projects in the fields of: community policing, live stock patrols, and highway safety; the judiciary, local law schools, bar associations, and legal aid agencies; and, the corrections system. Also acts as liaison between these South Sudanese entities and other components of the U.S. Mission. 7. Maintains the necessary professional and social relationships with South Sudanese justice sector officials (including police, prosecutors, justices, correction officials, academics, and other researchers) to ensure close, cooperative working relationships. 8. Assists in the preparation of such reporting as the annual budget request for International Narcotics, Crime and Law Enforcement (INCLE) funds and the Mission Resource Request. Coordinates annual reporting requirements for INL (e.g., the INCSR parts I and II, the End-Use Monitoring Report, etc). Helps administer the funds provided to implementers for support of the Government of South Sudan. Prepares program documentation and procurement requirements for assistance projects. Helps prepare regular reporting, as well as monthly status reports to INL/AME. 9. Analyzes and reports on law enforcement and justice sector developments in South Sudan, ensuring that the USG is fully informed on the capabilities, capacity, performance, and opportunities with regard to all elements of South Sudan's justice sector. 10. Briefs Department, Congressional, and other international dignitaries orally and in writing on the international law enforcement programs in South Sudan. Prepares documents for presentation to the U.S. Congress. Develops appropriate itinerary and accommodates official travelers, as necessary. Managerial 11. Ensures that the INL Office is an effective in channeling and coordinating INL assistance to the GoSS. 12. Establishes and maintains appropriate internal management control systems. Ensures that INL programs are not subject to waste, fraud, or mismanagement. Helps manage and monitor the use of all U.S.-provided commodities intended for justice sector purposes. 13. Provides analysis and guidance in project budget preparation, and program planning. 14. Conducts senior-level field surveys, evaluations, and special studies, as directed. 15. Maintains security awareness and properly handles classified and controlled items and information. E. POSITION ELEMENTS - PSC Acquisition Requirements and Duties The contractor shall assist in the full range of activities required to identify, acquire and deploy services and commodities necessary for project implementation. These activities may include: i. Development/identification of project services and commodity requirements including discussions with host nation counterpart personnel, ii. Conduct of market research to determine potential sources of supplies/services, iii. Contact with other USG agencies with similar requirements, iv. Acquisition planning, v. Drafting statements of work/specifications and evaluation criteria for use in solicitations, vi. Development of independent government estimates of the cost/price of project commodities and services, vii. Perform the duties of Contracting Officer's Representative (COR) where necessary, viii. Participate as a member of Technical Evaluation Panels established to review and evaluate potential contractors' proposals in response to formal solicitations; and ix. Successfully complete the Department of State's on-line course "How To Be a Contracting Officer's Representative (PA-178) within 120 days of arrival at post and provide a copy of the certificate of completion to the INL Director, the INL/AME Program Officer and the Contracting Office (INL/RM/MS), whether or not the contractor is expected to be formally designated as a COR. F. MINIMUM QUALIFICATIONS 1. a. U.S. citizenship, and able to obtain/maintain Department of State Moderate Level Public Trust security, ethics, and medical clearances. 2. Graduate degree from an accredited institution, preferably in the areas of law, business management, international development, international affairs, political science, public administration, or a related field. 3. Demonstrated experience drafting highly complex, analytical briefing papers, memoranda, letters, and reports for review and/or signature by senior-level officials. 4. Demonstrated experience working within international development programs; experience drafting related reports/documents, annual budgets, and strategic plan submissions. 5. Demonstrated on-the-ground international experience managing development programs in a post-conflict setting, to include design, monitoring and evaluation of programs. 6. Superior negotiation, interpersonal and managerial skills. 7. Excellent oral and written English communication skills. 8. Demonstrated experience in planning, strategizing, implementing and reporting on projects, including familiarity with basic requirements and mechanisms for contract management and procurement. 9. Working-level proficiency in Microsoft Office Suite. G. PREFERRED KNOWLEDGE AND SKILL: 1. Substantive knowledge and experience within Africa of rule of law or law enforcement programs. 2. Previous experience managing U.S. government assistance programs. 3. Previous experience in South Sudan. H. EVALUATION CRITERIA Factor 1 - Program Management (40%) Demonstrated experience in program management, especially in international programs involving multiple agencies that include foreign government entities; to include experience involving analytical, planning, management, advisory, operational, or evaluative duties. Factor 2 - International Experience (15%) Demonstrated experience managing programs in foreign, post-conflict environments; to include ability to live, work, and travel in difficult conditions with limited support, manage programs in a complex and fluid environment, and show good judgment in challenging security situations. Factor 3 - Interpersonal Relations (15%) Demonstrated experience in conducting meetings and discussions that justify, defend, negotiate, overcome resistance or settle highly significant or controversial issues; to include experience coordinating and/or integrating the work of participating groups with conflicting or undefined priorities, requiring accomplishment of major compromises in the project goals, techniques and methodologies prior to substantial progress. Factor 4 - Written Communication (15%) Demonstrated independent experience in preparing and writing reports, audits, memoranda, etc. in a subject area related to the duties of the position; to include reports and decision papers requiring independent analysis and having a significant impact in the program area on an international level. Factor 5 - Past Performance (15%) Evaluation of applicant's ability to perform under the same or similar contracts. (In conducting the evaluation, the Government reserves the right to utilize all evaluation information available at the time of evaluation, whether provided by the applicant or obtained from other sources.) I. COMPENSATION For award, INL will negotiate for this contract based on the following: • Entry-level salary is at Step 1 of the grade range assigned to solicitation • Consideration given for experience relevant specifically to the solicitation requirements • Level and extent of experience dictates the salary level within the grade range J. ETHICS REQUIREMENTS This solicitation may result in the award of one or more personal services contracts as defined in FAR 2.101. Prior to contract award, all offerors or quoters must advise the congnizant Contracting Officer if they have personal conflict or interest, such as a financial convlict, that would prevent them from either meeting the requirements of the clause entitled, "Post-Award Ethical Responsibilities of Personal Services Contractors", or otherwise objectively performing their contractual duties upon contract award. "Post-Award Ethical Responsibilities of Personal Services Contractor" - This is a personal services contract as defined in FAR2.101. The contractor shall be subject to the same ethical requirements and responsibilities as a member of the Civil Service or Foreign Service, including but not limited to the Standards of Ethical Conduct for Employees of the Executive Branch, 5CFR part 2635 and employee Responsibiliies Abroad, 3 FAM 4120. The contractor is required to complete and file the appropriate financial disclosure form, either form OGE-450, Confidential Financial Disclosure Report, or form OGE 278, Public Financial Disclosure Report, with the Department of State Ethics Office (L/Ethics) within thirty (30) days of the contract award if the position is one designated for filing. K.
