- Questions concerning RFI posted on 04 Oct 12: 1) DFARS 252.227-7015(b)(1)(iv) grants to the Government an unrestricted license to "use, modify, reproduce, release, perform, display, or disclose technical data, and to permit others to do so, that... [a]re necessary for operation, maintenance, installation, or training (other than detailed manufacturing or process data)." Additionally, 10 U.S.C. § 2320 governing military procurement generally, restricts the Government's rights to release or disclose technical data developed exclusively at private expense, except for technical data that "is necessary for operation, maintenance, installation, or training." Can the technical data delivered by the OEM to the Government be provided to other contractors for use on the intended contract under this solicitation for purposes of training pursuant to DFARS 252.227-7015? Answer: The contractor may have access to Country Specific Technical Orders (CSTO) to support training requirements. The contractor may establish a Technical Order Distribution Office (TODO) and the contractor's TODO can request copies of the required manuals via an AFTO Form 187 2) Can the technical data delivered by the OEM under DFARS 252.227-7015 be provided to a contractor for the manufacture of a flight simulator? Answer: Please see answer to question 1. 3) This contractor is aware of an FMS contract whereby the Government provided to the contractor technical data related to the C-130J as GFI for purposes of courseware development and training for the FMS customer, which customer has or is acquiring C-130J aircraft and training devices upon which the training will occur. If other FMS customers similarly own a C-130J aircraft and/or suitable training device, would AETC consider procuring C-130J training services for such FMS customers outside of the intended IDIQ contract under this solicitation where the customer's aircraft or trainer can be utilized for training ? Answer: Training under this Request for Information (RFI) will require that the C-130J maintenance training be accomplished prior to the first aircraft delivery as is necessary to provide the country initial operational capability (IOC). At this time AETC has no known requirement for training outside this intended IDIQ.
