Description

DEPARTMENT OF VETERANS AFFAIRS Justification and Approval For Other Than Full and Open Competition 1.Contracting Network Contracting Office (NCO) 10 VA HealthCare System of Ohio 6150 Oak Tree Boulevard - Suite 300 Independence, OH 44131 as requested by Cleveland VA Medical Center, will enter into a contract that requires justification for other than full and open competition. 2.Nature and/or Description of the Action Being Processed: Contractor shall provide databases, subscription management, online journals, books, linking services, and A-Z solutions subscriptions. A new annual firm fixed task order shall be sole sourced to EBSCO Industries VA101(49A3)-12-A-0008. EBSCO is one of three contractors who have been awarded a BOA contract by VALNET VA Library services. 3.Description of Supplies/Services Required to Meet the Agency's Needs: VA Ohio Healthcare System is requesting sole source procurement with "EBSCO Publishing" to renew existing database subscriptions. Estimated cost is $73,539.00. Period of Performance: Date of Award through September 30, 2013. The sole source justification for National Contracts has already been competed and technically reviewed by the Library Network Office Contracting Officer through fbo.gov. The justification for use is to save the VA time and money from doing a duplicate contracting action when an existing contract is already in place. 4.Statutory Authority Permitting Other than Full and Open Competition: ( X ) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1; ( ) (2) Unusual and Compelling Urgency per FAR 6.302-2; ( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per FAR 6.302-3; ( ) (4) International Agreement per FAR 6.302-4 ( ) (5) Authorized or Required by Statute FAR 6.302-5; ( ) (6) National Security per FAR 6.302-6; ( ) (7) Public Interest per FAR 6.302-7; 5.Demonstration that the Contractor's Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): EBSCO is the only company to provide customers with an integrated service that combines reference databases, subscription management, online journals, books, linking services, and A-Z solutions. EBSCO is the producer and developer of proprietary reference database products and services accessible through their industry recognized EBSCOhost Web Interface. No other company can provide this combination of databases, full text, and interface. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: Procurement was advertised in the Federal Business Opportunities by the Federal Library and Information Center Committee (FLICC). Online searches for comparable offerings and none were found. Questions posted to FEDLINK members, other networks, and directors of consortia confirmed no other comparable company known. 6.Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: Price analysis was performed by comparison of prices and discounts offered with commercial price lists. Prices are determined to be fair and reasonable. 7.Any Other Facts Supporting the Use of Other than Full and Open Competition: N/A 8.Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: N/A 9.A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: The justification for use is to save the VA time and money from doing a duplicate contracting action when an existing contract is already in place. 10.Requirements Certification: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
