Description: The Department of Veteran Affairs, San Francisco VA Medical Center, California, has a requirement to purchase Mosby Nursing Skills products. The solicitation is a BRAND NAME OR EQUAL, and an Equal will be considered. The resulting purchase will be a Firm-Fixed Price Agreement. FAR 52.211-6 Brand Name or Equal (Aug 1999) (a) If an item in this solicitation is identified as "brand name or equal," the purchase description reflects the characteristics and level of quality that will satisfy the Government's needs. The salient physical, functional, or performance characteristics that "equal" products must meet are specified in the solicitation. (b) To be considered for award, offers of "equal" products, including "equal" products of the brand name manufacturer, must- (1) Meet the salient physical, functional, or performance characteristic specified in this solicitation; (2) Clearly identify the item by- (i) Brand name, if any; and (ii) Make or model number; (3) Include descriptive literature such as illustrations, drawings, or a clear reference to previously furnished descriptive data or information available to the Contracting Officer; and (4) Clearly describe any modification the offeror plans to make in a product to make it conform to the solicitation requirements. Mark any descriptive material to clearly show the modification. (c) The Contracting Officer will evaluate "equal" products on the basis of information furnished by the offeror or identified in the offer and reasonably available to the Contracting Officer. The Contracting Officer is not responsible for locating or obtaining any information not identified in the offer. (d) To the maximum extent practicable, offerors are encouraged to respond to this solicitation using pre-existing materials (such as brochures, catalogs, marketing documents) rather than creating new documents. (e) Offerors shall annotate the salient characteristics listed above to indicate the location of the relevant information used to meet the specification (document name and page number). (f) Unless the offeror clearly indicates in its offer that the product being offered is an "equal" product, the offeror shall provide the brand name product referenced in the solicitation. (End of provision) Salient Characteristics: Offerors will be evaluated to the extent they can provide the items (or equal) listed in the price schedule in Section B. The Government will award to the lowest priced, responsible, technically acceptable offeror. The system must have the following characteristics equal to the Mosby Nursing Skills System, with the following features: "System must supply statistical value by title, for the number of full text information retrievals and the number of sessions. Use statistics must be available within two months of the date of use, and be available for any time period from one - twenty four months, by month. Turn-away statistics, on the number of users who were denied service because simultaneous use levels had been exceeded must be available for the same time period, by title and month. "No titles or information will be embargoed. All material available in print must be uploaded and available by the time it is offered in print, if not before. "The web-based software platform that the user sees must include indexing and access points by material title, subject (by controlled vocabulary or by keyword), date of publication, and author. "The vendor product must have provided reputable service to major institutions for at least the last three years, with less than 1% server downtime, and failures of service. "Vendor must supply references, with contact points, of at least three institutions that have used its service to provide the solicited product for at least two years. "Product does not require installation on each user's computer, but is accessible though a link that can be publicized on the restricted in-house Library website for SFVAMC. "Content must be peer-reviewed with reliable referencing and updated or reviewed for currency and accuracy at least monthly. FAR 52.212-2 EVALUATION--COMMERCIAL ITEMS (JAN 1999) (a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factor shall be used to evaluate offers: 1.Meeting the salient characteristics listed above. The Government will award to the lowest price, technically acceptable offeror. (b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s). (c) A written notice of award or acceptance of an offer mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
