Description
This is a combined synopsis/solicitation for commercial services and/or supplies prepared in accordance with the format in FAR Subpart 13.5 and FAR Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotations are being requested and a written solicitation will NOT be issued. The solicitation number for this requirement is VA259-12-Q-0302 and is hereby issued as a Request for Quote (RFQ) using subpart FAR Part 13, Simplified Acquisition Procedures. The Department of Veterans Affairs, VHA, George E. Whalen VA Medical Center in Salt Lake City, Utah requires a contract for the following item: An eleven-month base period (CLIN's 0001 - 0004) and four 1-year possible options (CLINS 1004 - 4004) for lab testing to monitor water and dialysate used in the Renal Dialysis and Dental Departments of the VAMC. (See the attached Statement of Work (SoW) for specific details.) The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-61 effective 13 Sept 12. The North American Industry Classification System (NAICS) code is 621511 - Medical Laboratories and the Small Business Size Standard is $13.5M. This procurement is unrestricted by business size and socio-economic category and competition is full and open. Women and women owned, service disabled veteran owned, and small disadvantaged businesses are strongly encouraged to submit quotes. The Government intends to issue a firm fixed price contract to the responsible Offeror whose lowest price and technically acceptable quote conforms to the solicitation. Only technically acceptable offers will be considered. The Government intends to evaluate offers and make award without discussions; however, this does not preclude the Government from having discussions if it is in the best interest of the Government. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor within 30 days before the contract expires. 52.217-9 - Option to Extend the Term of the Contract (Mar 2000) (a) The Government may extend the term of this contract by written notice to the Contractor within 30 calendar days before the contract expires; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 60 calendar days before the contract expires. The preliminary notice does not commit the Government to an extension. (b) If the Government exercises this option, the extended contract shall be considered to include this option clause. (c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed 5 Years. (End of Clause) 52.219-28 - Post-Award Small Business Program Representation. (June 2007) (a) Definitions. As used in this clause-- Long-term contract means a contract of more than five years in duration, including options. However, the term does not include contracts that exceed five years in duration because the period of performance has been extended for a cumulative period not to exceed six months under the clause at 52.217-8, Option to Extend Services, or other appropriate authority. Small business concern means a concern, including its affiliates that is independently owned and operated, not dominant in the field of operation in which it is bidding on Government contracts, and qualified as a small business under the criteria in 13 CFR part 121 and the size standard in paragraph (c) of this clause. (b) If the Contractor represented that it was a small business concern prior to award of this contract, the Contractor shall re represent its size status according to paragraph (e) of this clause or, if applicable, paragraph (g) of this clause, upon the occurrence of any of the following: (1) Within 30 days after execution of a novation agreement or within 30 days after modification of the contract to include this clause, if the novation agreement was executed prior to inclusion of this clause in the contract. (2) Within 30 days after a merger or acquisition that does not require a novation or within 30 days after modification of the contract to include this clause, if the merger or acquisition occurred prior to inclusion of this clause in the contract. (3) For long-term contracts- (i) Within 60 to 120 days prior to the end of the fifth year of the contract; and (ii) Within 60 to 120 days prior to the exercise date specified in the contract for any option thereafter. (c) The Contractor shall rerepresent its size status in accordance with the size standard in effect at the time of this rerepresentation that corresponds to the North American Industry Classification System (NAICS) code assigned to this contract. The small business size standard corresponding to this NAICS code can be found at http://www.sba.gov/services/contractingopportunities/sizestandardstopics/. (d) The small business size standard for a Contractor providing a product which it does not manufacture itself, for a contract other than a construction or service contract, is 500 employees. (e) Except as provided in paragraph (g) of this clause, the Contractor shall make the rerepresentation required by paragraph (b) of this clause by validating or updating all its representations in the Online Representations and Certifications Application and its data in the Central Contractor Registration, as necessary, to ensure they reflect current status. The Contractor shall notify the contracting office by e-mail, or otherwise in writing, that the data have been validated or updated, and provide the date of the validation or update. (f) If the Contractor represented that it was other than a small business concern prior to award of this contract, the Contractor may, but is not required to, take the actions required by paragraphs (e) or (g) of this clause. (End of clause) FAR 52.212-1, Instruction to Offerors-Commercial Items-ADDENDUM OFFER PREPARATION INSTRUCTIONS: Provide the following information: 1) RFQ number, 2) time specified for receipt of offers, 3) name, address, and telephone number of offeror, 4) terms of any express warranty, 5) price and any discount terms, 6) a completed copy of the representations and certifications at FAR.212-3 Alt 1 Offeror Representations and Certifications-Commercial Items (see FAR 52.212-3(j) for those representations and certifications that the offeror shall complete electronically); Offers that fail to furnish required representations or information, or reject the terms and conditions of the solicitation may be excluded from consideration. (IAW FAR 4.1201 prospective contractors must be registered in the Online Representative & Certification Application (ORCA) at http://orca.bpn.gov - now https://www.sam.gov 7) Period for acceptance of offers - The offeror agrees to hold the prices in its offer firm for 30 calendar days from the date specified for receipt of offers, unless another time period is specified in an addendum to the solicitation, 8) late offers - Any offer, modification, revision, or withdrawal of an offer received at the Government office designated in the solicitation after the exact time specified for receipt of offers is "late" and will not be considered. 52.212-2 Evaluation-Commercial Items (Jan 1999) (a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers: BASIS OF AWARD: 1) Award will be made to the offeror whose lowest price and technically acceptable quote conforms to the solicitation. (b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s). (c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award. (End of Provision) STATEMENT OF WORK (SoW) A.GENERAL INFORMATION 1.Title of Project: Water Testing for Renal Dialysis and Dental Service at the VA Salt Lake City Health Care System, located at 500 Foothill Drive, Salt Lake City, Utah 84148. 2.Scope of Work: The contractor shall provide all personnel, supervision, professional expertise, materials, equipment and quality control to provide accurate and reliable testing and monitoring of the water and dialysate used in the Renal and Dental sections of the VA Salt Lake City Medical Center. The Contractor shall be a licensed and accredited laboratory. A copy of the licenses shall be provided with the Contractor's quote. 3.Background: The VA is required to monitor water and dialysate used in the Renal Dialysis and Dental sections. The purpose of this testing is to avoid potential contamination of the water system which could result in the infection of every patient on dialysis and every patient seen in the dental section. The water system is specialized, but it is used in the dialysis machines which access patient's circulatory systems in order to accomplish the dialysis. A contamination of the water system would be catastrophic and infect those patients resulting in serious morbidity. A similar situation exists in the Dental Services section where patients undergoing oral surgery and other procedures would be seriously compromised with contaminated water. The following is a requirement of the Joint Commission: AAMI (Association for the Advancement of Medical Instrumentation) RD-52 states that dialysate be tested for bacteria and endotoxin monthly. The level of bacteria and endotoxin (LAL) that should be met is the same as that of the water system. Also, the EPA, APHA and AWWA set standards for dental unit water lines. Also described in VA SLC policy 111.07 (available upon request). 4.Period of Performance: The period of performance will be one base year and four (4) one-year option years. The base year period of performance will be from Date of Award and end on August 31, 2013. Each option year will begin on September 1st of the subsequent year. This contract will not extend beyond August 31, 2017. 5.Type of Contract: The Government intends to award a Firm-Fixed Price contract in accordance with FAR Subpart 16.202-2. 6.Place of Performance: Contractor's facility. B.CONTRACT AWARD MEETING The Contractor shall not commence performance on the tasks in this SOW until the Contracting Officer has conducted a post award meeting or has advised the Contractor that a post award meeting is waived. C.SPECIFIC MANDATORY TASKS 1.The service will include the Contractor providing labrotary testing to monitor water and dialysate in accordance with industry accepted procedures applicable to such laboratory services and pursuant to manufacturer standards. 2.VA personnel will take samples of the water and dialysate periodically during the month and will refrigerate the samples immediately. 3.Multiple samples may be taken at one time which will constitute a batch. Batch size may vary from month to month. 4.VA personnel will arrange for transportation of the refrigerated samples to the Contractor. 5.The Contractor will conduct Bio-Burden tests on the samples to determine Heterotrophic Bacteria is present. This test is performed for the Dental section with approximately thirty (30) samples per quarter requiring testing. 6.The Contractor will conduct LAL Kinetic Turbidimetric tests on samples provided by the Renal Dialysis department to determine the levels of endotoxins present. Approximately twelve (12) samples per month requiring testing to ensure the integrity of the osmotic water system. 7.The Contractor will conduct Microbial tests on the samples to determine Bacterial and Pyrogen levels present. This test is performed for the Renal Dialysis section with approximately twelve (12) samples per month requiring testing. 8.When a positive test is encountered, the Contractor shall contact the point of contact immediately at the VA so a STAT sample can be taken and delivered to the Contractor for immediate re-test for confirmation of the positive test result. 9.Normal test results shall be reported to the VA within 48 hours of results. D.GOVERNMENT RESPONSIBILITIES 1.VA personnel shall take samples of the water and dialysate periodically throughout the month and shall refrigerate the samples immediately. 2. VA personnel shall be responsible for shipping/sending the samples to the laboratory.
