Description
This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice.The solicitation number is 10692M2220 and is issued as a request for quote (RFQ), unless otherwise indicated herein. The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular FAC 2005-60. The associated North American Industrial Classification System (NAICS) code for this procurement is 541720 with a small business size standard of $19 Million 3 year annual average. This requirement is a total small business set-aside and only qualified offerors may submit quotes. This solicitation will end on 2012-09-24 5:30 PM Eastern Time or as otherwise displayed at www.FBO.gov. FOB Destination shall be Arlington, VA 22209. The Department of State requires the following educational services to assist in a course curriculum development on Human Trafficking specifically related to DS Agents who may encounter issues while on duty worldwide: Online Human Trafficking Training and Reference Guide for Diplomatic Security Special Agents Scope of Work: Diplomatic Security requires subject matter expertise to assist this bureau in developing an online training awareness curriculum to assist Regional Security Officers and other DS agents understanding Human Trafficking issues. The Contractor will assist DS and other DOS offices in coordinating and developing an online human trafficking training module and reference guide for its criminal investigators stationed worldwide. These special agents are in the position to identify and investigate human trafficking by nature of their federal law enforcement positions in almost every country in the world, combined with their core duty to investigate visa fraud. The Department of State requires a Contractor to collaboratively develop with DS a one-hour online course with the inclusion of a practical reference guide, working closely with Diplomatic Security to ensure that the course and reference guide is tailored to the participating agents specific needs for the Bureau of Diplomatic Security. A web-based training curriculum and corresponding reference guide offers Diplomatic Security a cost-effective and sustainable opportunity, reaching a maximum number of agents without significant travel and in-person training costs. By being available at any time, the training offers timely access to information to agents who regularly rotate their details and may be in a position where immediate information is particularly helpful. Diplomatic Security can easily notify agents about the training by email and through FSI course offerings and immediately launch the course. Agents have the added benefit of returning to the reference guide, which offers information on what to do once they identify human trafficking. The Subject Matter Expert on Human Trafficking will assist on a fixed price basis DS develop the curriculum fleshing out the details of the following outline: OUTLINE Module 1: Course Introduction • Boilerplate module that includes: course objectives, audience, course usage instructions Module 2: Overview - What is Human Trafficking? • Key elements of trafficking and statistics on occurrence in the United States • Differentiate trafficking vs. smuggling - provide several case briefs • Explain major streams of trafficking, ie labor trafficking, sex trafficking, indentured servitude, child trafficking • Identify legal statutes that relate to trafficking - Trafficking Victims Protection Act, 18 USC 1546, 8 USC 1324, other statutes etc. Module 3: Trafficking and Visa Fraud • Identify the trafficking schemes that DS would generally investigate • A-3 and G-5 indentured servitude (explain sensitivities of investigating foreign diplomats) • H & L labor trafficking • J-1s and sex trafficking • Provide case studies for each type of scheme based on DS involvement in the past Module 4: Role of DS Agents in Combating Trafficking • Identification of trafficking victims and schemes in progress • Red flags and best practices for identification • Engagement with host country governments, NGOs • Engagement with embassy staff - CA officers/FPU/LGF and SD teams on identification • Engagement with local LE for domestic agents • Map of domestic HT task forces that have active DS presence Module 5: Interviewing Potential Victims • Do's and Don'ts • Cultural sensitivities • Key questions to elicit information necessary for investigation/prosecution Module 6: Post-identification Action • Action tree for who to contact in which cases - DS/CR/CFI, J/TIP hotline, care providers, victim witness assistance providers • The T visa - what it is, how to apply for it; deferred action from DHS for cooperators Module 7: Debriefing • Reiterate the following objectives from previous modules: 1. Identify key elements of human trafficking and how it differentiates from typical VF and smuggling schemes 2. Identify typical schemes that DS agents would encounter domestically or overseas 3. Identify best practices for engaging with DS/CA/host country/other LE entities and for identifying victims 4. Identify best practices for interviewing trafficking victims 5. What to do when you have discovered trafficking Module 8: Links to Resources • Sample interview questions • Sample affidavits to use in charging documents • Case studies from previous successful prosecutions • Contact list for NGOs/care providers categorized by geographic location and area of expertise • Internal resources available through VRAP • Sample T visa application • Library of statutes related to trafficking - federal and state Reference Guide summarizing all to be included. Each firm must offer a fixed price total bottom line amount to perform collaborative work as described above, and use there industry expertise on Human Trafficking to assist the Bureau of Diplomatic Security develop the project from start to the launching of the training which will be considered complettion. ***Question Submission: Interested offerors must submit any questions concerning the solicitation at the earliest time possible to enable the Buyer to respond via email to Sanchezvj@state.gov. Questions not received within a reasonable time prior to close of the solicitation may not be considered.*** This solicitation requires registration with the System for Award Management (SAM) prior to award, pursuant to FAR 4.1102 and other applicable regulations and guidelines. The selected Offeror must comply with the following commercial item terms and conditions. FAR 52.212-1, Instructions to Offerors - Commercial, FAR 52.212-2 Evaluation of Commercial items applies to this acquisition. The selected Offeror must submit a completed copy of the provision at 52.212-3, Offeror Representations and Certifications - Commercial Items. FAR 52.212-2 Evaluation Commercial Items applies. FAR 52.212-4, Contract Terms and Conditions - Commercial Items, applies to this acquisition. The following FAR clauses in paragraph (b) of FAR clause 52.212-5, Contract Terms and Conditions Required To Implement Statutes or Executive Orders-Commercial Items, will apply: 52.222-21, 52.222-26, 52.222-35, 52.222-36, 52.222-37, 52.225-13, 52.232-34. The Contractor and its employees shall exercise the utmost discretion in regard to all matters relating to their duties and functions. They shall not communicate to any person any information known to them by reason of their performance of services under this contract which has not been made public, except in the necessary performance of their duties or upon written authorization of the Contracting Officer. All documents and records (including photographs) generated during the performance of work under this contract shall be for the sole use and become the exclusive property of the U.S Government. Furthermore, no article, book, pamphlet, email, recording, broadcast, speech television appearance, film or photograph concerning any aspect of work performed under this contract shall be published or disseminated through any media without the prior written authorization of the Contracting Officer. These obligations do no cease upon the expiration or termination of this contract. The Contractor shall include the substance of this provision in all contracts of employment and in all subcontracts hereunder. All quoted prices must include a breakdown of the one total bottom line fixed price, in order to participate in the development of the subject curriculum, the total price should be inclusive of all labor, overhead, G&A, profit and any other loadings to include travel and overtime anticipated. An evaluation will be conducted based on best value, where past performance, credentials and experience in the Human Trafficking field along with technical compliance as defined by staying as close to the listed specifications as identified are more important than price.
