- The Federal Communications Commission (FCC) intends to purchase a sole source requirement with ProQuest for the ProQuest Digital U. S. Bills and Resolutions Collection. This will provide fully searchable PDFs for all versions of the all U.S. bills and resolutions from 1789 to present that have been introduced to congress regardless of whether they became public law. This information is significant as the FCC has a need to conduct research on the legislative history of topics that have or have never become public law. The information contained in the bills are imperative to compiling a complete legislative history, determining where and how concepts and language that eventually become public law were introduced. The FCC requires the collection of legislative histories pertaining to the Communications Act beginning as the Radio Act of 1789 and amended through the Telecommunications Act of 1996. The histories include various materials generated in the course of creating legislation, such as committee reports, analysis by legislative counsel, committee hearings, floor debates, and histories of actions taken. The histories are used for discovering sources of information about a legislature's intent in enacting a law. No other directory of information is currently available on the market that allows this magnitude of information to be purchased together. The period of performance for this effort is for one year beginning Sept 25, 2012 thru Sept 24, 2013. This notice of intent is not a request for proposals or quotations. The authority for negotiating a sole source bases is made under 41 U.S.C. 253 (c)(1) and FAR 13.106-1 which permits soliciting from a single source, if the contracting officer determines that the circumstances of the contract action deem only one source is reasonably available. The North American Industry Classification System (NAICS) Code is 519130. Any challenges to this sole source requirement must be received by September 20, 2012, NO later than 1:00pm Washington D.C. local time, in writing, and sent to gary.klaff@fcc.gov to be considered by the Government for the purpose of determining whether or not to compete the requirement. Challenges must include information sufficient to enable the Government's needs as stated herein. A determination by the Government not to compete this proposed requirement based on responses to this notice is solely within the discretion of the Government. If the FCC identifies no other capable sources by 1:00p.m Washington D.C. local time on September 20, 2012, the FCC will issue a Firm-Fixed Price Contract to ProQuest, 789 E Eisenhower Parkway, Ann Arbor MI, 48108.
