- Documents for Bid Submission This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; bids are being requested and a written solicitation will not be issued. The Federal Bureau of Prisons, Field Acquisition Office, Grand Prairie, Texas intends to award a firm-fixed price contract to a responsible small business entity for the provision of fresh beef and poultry products for the Federal Correctional Complex (FCC) located in Terre Haute, Indiana. Additional information regarding the Federal Bureau of Prisons and FCC Terre Haute is located at www.bop.gov. A description of the required food items and quantities is included in the attached Schedule of Items. CONTRACT CLAUSES: 52.252-2 -- Clauses Incorporated by Reference (Feb 1998). This contract incorporates one or more clauses by reference, with the same force and effect as if they were given in full text. Upon request, the Contracting Officer will make their full text available. Also, the full text of a FAR clause may be accessed electronically at this address: www.acquisition.gov. Full text copies of Justice Acquisition Regulation (JAR) clauses or BOP clauses may be requested in writing from the Contracting Officer. 52.212-4 Contract Terms and Conditions--Commercial Items (FEB 2012) with addendum to incorporate the additional clauses listed below into this solicitation and any resulting contract. 52.203-12 Limitation on Payments to Influence Certain Federal Transactions (OCT 2010) 52.204-4 Printed or copied doubled-sided on recycled paper (AUG 2000) 52.204-7 Central Contractor Registration (APR 2008) 52.232-18 Availability of Funds (APR 1984) 52.253-1 Computer Generated Forms (JAN 1991) The following clauses will be incorporated into a resultant contract in full text with applicable fill-in information as noted: 52.211-16 Variations in Quantity (APR 1984) - (b) 1 percent increase - 2 percent decrease; n/a Evaluation of Contractor Performance Utilizing CPARS (APR 2011) 52.212-5 Contract Terms and Conditions Required to Implement Statutes or Executive Orders - Commercial Items (AUG 2012)-(b) 1, 4, 6, 10, 12, 14, 17, 23, 26-33, 38, 39, 42, 47. OTHER CONTRACT TERMS AND CONDITIONS: Type of Contract: A resultant contract will be a firm/fixed price type contract. It is anticipated that a contract award resulting from this solicitation will be made in September 2012. Note: Multiple awards may result from the solicitation if determined by the Contracting Officer to be advantageous to the Government. Contracting Officer Responsibility: Authority to negotiate changes in the terms, conditions, or amounts cited in a resultant contract is reserved to the Contracting Officer; however, the responsibility may be delegated to an officer of the Contract Administration Office. Contract Administration Office (CAO): Upon award, the Contracting Office at FCC Terre Haute is assigned to be the CAO. This assignment carries with it the authority to perform all normal contract administration functions listed in FAR 42.302(a), items (1) through (70); to the extent those functions apply to the subject contract. This assignment also includes delegation of authority to perform functions specified in FAR 42.302(b), items (1) through (11). SOLICITATION PROVISIONS: 52.252-1 Solicitation Provisions Incorporated by Reference (FEB 1998) This solicitation incorporates one or more provisions by reference, with the same force and effect as if they were given in full text. Also, the full text of a FAR clause may be accessed electronically at this address: www.acquisition.gov 52.212-1 Instructions to Offerors - Commercial Items (FEB 2012) tailored to delete paragraphs at e and i as they have been determined to be non-applicable to this solicitation. Paragraph c is changed from 30 days to 90 days and all references to "Offerors" and "Offers" are hereby changed to "Bidders" and "Bids". The additional provisions listed below are incorporated into this solicitation via addendum to this provision. 52.212-3 Offeror Representations and Certifications - Commercial Items (APR 2012) 52.203-11 Certification and Disclosure Regarding Payments to Influence Certain Federal Transactions (SEP 2007) 52.233-2 Service of Protest (AUG 1996) (a) Procurement Executive, BOP, 320 First Street, N.W., Room 5005, Washington, D.C. 20534 Protests Filed Directly with the Department of Justice (JAR 2852.233-70) Faith-Based and Community- Based Organizations (AUG 2005) - can submit offers/bids/quotations equally with other organizations for contracts for which they are eligible. 52.214-7 Late Submissions, Modifications, and Withdrawals of Bids (NOV 1999) 52.214-22 Evaluation of Bids for Multiple Awards (March 1990 The following solicitation provisions are applicable to this IFB and are listed below in full text: 52.214-4 False Statements in Bids (APR 1984) Bidders must provide full, accurate, and complete information as required by this solicitation and its attachments. The penalty for making false statements in bids is prescribed in 18 U.S.C. 1001. 52.214-5 Submission of Bids (MAR 1997) (a) Bids and bid modifications shall be submitted in sealed envelopes or packages (unless submitted by electronic means) (1) Addressed to the office specified in the solicitation; and (2) Showing the time and date specified for receipt, the solicitation number, and the name and address of the bidder. (b) Bidders using commercial carrier services shall ensure that the bid is addressed and marked on the outermost envelope or wrapper as prescribed in paragraphs (a)(1) and (2) of this provision when delivered to the office specified in the solicitation. (c) Telegraphic bids will not be considered unless authorized by the solicitation; however, bids may be modified or withdrawn by written or telegraphic notice. (d) Facsimile bids, modifications, or withdrawals, will not be considered unless authorized by the solicitation. (e) Bids submitted by electronic commerce shall be considered only if the electronic commerce method was specifically stipulated or permitted by the solicitation. 52.214-6 Explanation to Prospective Bidders (APR 1984) Any prospective bidder desiring an explanation or interpretation of the solicitation, drawings, specifications, etc., must request it in writing soon enough to allow a reply to reach all prospective bidders before the submission of their bids. Oral explanations or instructions given before the award of a contract will not be binding. Any information given a prospective bidder concerning a solicitation will be furnished promptly to all other prospective bidders as an amendment to the solicitation, if that information is necessary in submitting bids or if the lack of it would be prejudicial to other prospective bidders. 52.214-10 Contract Award - Sealed Bidding (JUL 1990) (a) The Government will evaluate bids in response to this solicitation without discussions and will award a contract to the responsible bidder whose bid, conforming to the solicitation, will be most advantageous to the Government considering only price and the price-related factors specified elsewhere in the solicitation. (b) The Government may- (1) Reject any or all bids; (2) Accept other than the lowest bid; and (3) Waive informalities or minor irregularities in bids received. (c) The Government may accept any item or group of items of a bid, unless the bidder qualifies the bid by specific limitations. Unless otherwise provided in the Schedule, bids may be submitted for quantities less than those specified. The Government reserves the right to make an award on any item for a quantity less than the quantity offered, at the unit prices offered, unless the bidder specifies otherwise in the bid. (d) A written award or acceptance of a bid mailed or otherwise furnished to the successful bidder within the time for acceptance specified in the bid shall result in a binding contract without further action by either party. (e) The Government may reject a bid as nonresponsive if the prices bid are materially unbalanced between line items or subline items. A bid is materially unbalanced when it is based on prices significantly less than cost for some work and prices which are significantly overstated in relation to cost for other work, and if there is a reasonable doubt that the bid will result in the lowest overall cost to the Government even though it may be the low evaluated bid, or if it is so unbalanced as to be tantamount to allowing an advance payment. (End of provision) ADDITIONAL SOLICITATION PROVISIONS: Bidders are advised that the Contracting Officer will verify registration in the System for Award Management (SAM) website (www.sam.gov) prior to award of any contract, by entering the potential awardee DUNS number into the database. Failure to complete the registration may result in elimination from consideration for award. Bidders are further advised to mark each individual item within their bid considered privileged or confidential under the Freedom of Information Act with notification that the data is considered confidential and privileged and not subject to mandatory disclosure under the FOIA. Bidders are hereby notified that the government may require a product sample to be provided prior to award. If a sample is requested, the bidder shall provide a sampling of the product within 72 hours of written request. In accordance with FAR 52.212-1 (d), product samples shall be submitted at no expense to the Government. The North American Industrial Classification (NAICS) code is 311999, All Other Miscellaneous Food Manufacturing, with the applicable small business size standard of 500 employees. This IFB is set-aside 100% for small businesses. BID PACKAGE PREPARATION: Instructions for Preparation (includes Schedule of Items for pricing) of your bid package are attached to this posting and labeled as Attachment 002. BID SUBMISSION INFORMATION: Sealed bids must be received at the Federal Bureau of Prisons, Field Acquisition Office, Armed Forces Reserve Complex, 346 Marine Forces Drive, Grand Prairie, TX, 75051 no later than 10:00 a.m. local time on Thursday, September 13, 2012. The label (see attachment 003) shall be placed on the envelope containing the bid. The envelope shall be placed inside of a shipping box or envelope supplied by a carrier such as U.S. Mail, Fed-Ex, or UPS etc. Complete the information on the label and cut and paste or transfer it to the lower left corner of the envelope containing your bid. Print or type your name and address in the upper left corner of the envelope containing your bid. Bids will be accepted by mail/courier or hand-carried. Mailed or Hand-carried bids must be delivered to the attention of Rod Wise, Contracting officer at the address shown. The official point of receipt for hand-carried bids will be at the first floor reception area of the address listed above. The label (see attachment 001) shall be placed on the outside of the sealed envelope and shall contain the required information. Please give 24 hour of advanced notice to Contracting Officer or designee prior to hand-carrying bids in order to accommodate access to the secured base. Faxed or e-mailed bids will not be accepted. Any bidder desiring to be present during a bid opening, occurring at the FBOP Field Acquisition Office located at Grand Prairie, Texas, must submit the name of the person who will attend the bid opening no less than 48 hours in advance of the bid opening. Visitors will be required to present identification at the security check point, and to the official conducting the bid opening. 46.503-Place of Acceptance; The point of acceptance for items supplied under a contract will be at the Federal Correctional Complex, 4700 Bureau Road South, Terre Haute, IN 47802 Questions regarding this requirement may be directed in writing to Rod Wise, Contracting Officer at rwise@bop.gov.
