- Reference Number: NHLBI-CSB-AR-2012-294-CSP Title: Notice of Intent to Award Sole Source to Nugen Technologies, Inc for the Mondrian Workstation and Multiplex System The National Heart, Lung, and Blood Institute (NHLBI), Office of Acquisitions (OA), on behalf of the National Institute of Arthritis and Musculoskeletal and Skin Diseases (NIAMS), intends to negotiate on a sole source basis and award a purchase order, for the Mondrian Workstation and Multiplex System, to Nugen Technologies, Inc., 201 Industrial Rd, Suite 310, San Carlos CA, 94070-3331, under the authority of (FAR) Subpart 13.106-1. "(b) Soliciting from a single source. This notice of intent is not a request for competitive proposals. This announcement constitutes the only notice; proposals are not being requested and a written solicitation will not be issued. This solicitation and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-60, August 27, 2012. The corresponding NAICS code is 541711-Research and Development in Biotechnology and the small business size standard is 500 Employees. The basis for the sole source determination: The sole source determination is based on the fact that the Nugen Mondrian SP instrument and workstation is exclusive to Nugen Technologies, and is the only digital microfluidic device on the market that utilizes this patented technology (patent number 7,255,780 and 7,943,030 with additional patents pending). It is sold exclusively by Nugen, and can only be serviced by Nugen engineers. The unit requires the use of disposable cartridges also covered under the aforementioned patents and reagents developed by Nugen (covered under additional patents) that have been engineered and validated to work with this instrument. Interested parties may identify their interest and capability to respond to the requirement, in writing, no later than the response date. Written responses to this notice shall contain sufficient documentation to establish a bona fide capability to fulfill the requirement. Written responses shall reference this Notice of Intent No. NHLBI-CSB-AR-2012-294-CSP and may be submitted electronically NO LATER THAN 9:00 A.M. EASTERN STANDARD TIME September 04, 2012 to the Contract Specialist, Caitlin Palmer at: Caitlin.palmer@nih.gov. A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement.
