- Statement of Work This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested and a written solicitation will not be issued. This solicitation will be evaluated and awarded per the prescribed procedures of FAR Part 13, Simplified Acquisition Procedures. The solicitation number for this procurement is FA4803-12-Q-B154 and is issued as a Request for Proposal (RFP). This solicitation document and incorporated provisions and clauses are those in effect through the Federal Acquisition Circular (FAC) 2005-60, 20120726, Defense Federal Acquisition Regulation Supplement Procurement Notice (DPN) 20120724 and Air Force Acquisition Circular (AFAC) 2012-0330. The North American Industry Classification System code for this acquisition is 611710, with a Woman Owned Small Business Size Standard of $4,000,000.00. This acquisition is a 100% Woman Owned Small Business Set-Aside. This is a Firm Fixed Price procurement and will be procured using commercial item procedures and award selection will be made based on Low Price Technical Acceptable (LPTA). This requirement is for the following: Test Administrator for Shaw AFB, South Carolina, capable of working 473 units a year (1 unit = 4 hours) in accordance with the attached Statement of Work (SOW) and incorporates Wage Determination 05-2475 (Rev.-14), 20120619. Contractor shall provide and abide by all requirements stated in the Statement of Work (SOW). This requirement is for a one year base period and two one year options. CLIN 0001 - Base year______x (NTE) 473 units/year (1 Oct 2012 through 30 September 2013) CLIN 1001 - Option year 1___x (NTE) 473 units/year (1 Oct 2013 through 30 September 2014) CLIN 2001 - Option year 2___x (NTE) 473 units/year (1 Oct 2015 through 30 September 2015) The RFP submitted shall contain the following information: RFP number, time specified for receipt of offers, name, address, telephone number of offeror, technical proposal, pricing information, any discount terms and acknowledgement of all solicitation amendments (if applicable). Technical proposal shall also contain all other documentation specified. The Contracting Officer is not responsible for locating or obtaining any information not identified in the proposal. Period of Acceptance for Offerors: The offeror agrees to hold its offer firm for 60 calendar days from the date specified for receipt of offers, unless another time period is stated in an addendum to the solicitation. Late offers: Request for Quotations or modification of quotes received at the address specified for the receipt of offers after the exact time specified for receipt of offers will be handled in accordance with FAR 52.212-1(f). The following FAR clauses and provisions apply to this acquisition: FAR 52.212-1, Instructions to Offerors -- Commercial Items (Feb 2012). (b). Submission of Offers: All offers shall be received no later than NLT 2:00pm EST, 7 Sep 2012. Proposals may be submitted to Robert Hunter at robert.hunter@shaw.af.mil. (b) (1). Late offers: Request for proposals or modification of proposals received at the address specified for the receipt of offers after the exact time specified for receipt of offers will not be considered. (b)(2). Technical Proposal: The technical proposal shall address the offeror's ability to meet the requirements set forth in the SOW. Unnecessary elaboration or other presentations beyond that sufficient to present a complete and effective proposal are not desired and may be construed as an indication of the offeror's lack of understanding. The information or document shall contain all the pertinent information necessary to permit evaluation of proposal. The technical information or document shall contain no pricing information. (i). The technical proposal shall include a narrative addressing capability to meet SOW requirements along with any pertinent documents supporting the qualifications outlined in the Statement of Work (paragraph 3). (ii). Pricing is to be completed on a separate attachment. FAR 52.212-2, Evaluation -- Commercial Items (Jan 1999) (a). The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers as Low Price Technically Acceptable (LPTA) in accordance with the procedures and latitude available at FAR Part 13. 1. Price. 2. Technical. Pass or Fail. (i). Meet or exceeds the requirements of the Statement of Work by thoroughly demonstrating their capability to perform and satisfy the qualifications outlined in the Statement of Work (paragraph 3). (ii). Meets the educational requirement. (b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s). (c) A written notice of award or acceptance of an offer mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award. FAR 52.212-5 Contract Terms and Conditions Required to Implement Statutes or Executive Orders-Commercial Items (DEVIATION) (a) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (a) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records -- Negotiation. (1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract. (2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved. (3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law. (b) (1) Notwithstanding the requirements of any other clause in this contract, the Contractor is not required to flow down any FAR clause, other than those in this paragraph (b)(1) in a subcontract for commercial items. Unless otherwise indicated below, the extent of the flow down shall be as required by the clause- (i) 52.203-13, Contractor Code of Business Ethics and Conduct (Apr 2010) (Pub. L. 110-252, Title VI, Chapter 1 (41 U.S.C. 251 note)). (iii) 52.219-8, Utilization of Small Business Concerns (Dec 2010) (15 U.S.C. 637(d)(2) and (3)), in all subcontracts that offer further subcontracting opportunities. If the subcontract (except subcontracts to small business concerns) exceeds $650,000 ($1.5 million for construction of any public facility), the subcontractor must include 52.219-8 in lower tier subcontracts that offer subcontracting opportunities (iv) [Reserved] (iv) 52.222-26, Equal Opportunity (Mar 2007) (E.O. 11246). (2) While not required, the contractor may include in its subcontracts for commercial items a minimal number of additional clauses necessary to satisfy its contractual obligations. (End of Clause) FAR 52.217-8, Option to Extend Services (Nov 1999) The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor within 30 calendar days. (End of Clause) FAR 52.217-9 Option to Extend the Term of the Contract (Mar 2000) (a) The Government may extend the term of this contract by written notice to the Contractor within 30 calendar days; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 60 calendar days before the contract expires. The preliminary notice does not commit the Government to an extension. (b) If the Government exercises this option, the extended contract shall be considered to include this option clause. (c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed 3 years 6 months. (End of Clause) FAR 52.222-42 Statement of Equivalent Rates for Federal Hires; Statement of Equivalent Rates for Federal Hires (May 1989) In compliance with the Service Contract Act of 1965, as amended, and the regulations of the Secretary of Labor (29 CFR Part 4), this clause identifies the classes of service employees expected to be employed under the contract and states the wages and fringe benefits payable to each if they were employed by the contracting agency subject to the provisions of 5 U.S.C. 5341 or 5332.
