Description
LIMITED SOURCES JUSTIFICATION & APPROVAL I. CONTRACTING ORGANIZATION : The organization responsible for this action is the 4th Contracting Squadron, 1600 Wright Brothers Avenue, Seymour Johnson AFB (SJAFB), NC, 27531. II. DESCRIPTION OF ACTION : T he contractual action is a Sole Source Firm-Fixed price contract for the purchase and installation of upgrades for Monaco Enterprises D-21 mobile upgrade with vehicle tracking, 4 th Security Forces Squadron, Seymour Johnson AFB. III. DESCRIPTION OF SUPPLIES/SERVICES : To purchase and install two (2) Monaco Enterprises D-21 Automatic Vehicle Location Systems with Incident command. These systems will interact with the current Monaco systems in place. IV. AUTHORITY : The statutory authority permitting other than full and open competition for this acquisition is 10 U.S.C. 2304(c)(1) and the Federal Acquisition Regulation Part 8.405-6 – Limited Sources. V. APPLICABLITY OF AUTHORITY : Request to award this requirement to only one responsible source since the items listed in item II are developed, designed, and manufactured by Monaco Enterprises. The original system (Monaco) and the upgraded system must be compatible and work properly together and the only way to ensure this happens is to award this upgrade as a sole source requirement to Monaco. Monaco Enterprises has proprietary rights to all parts and specifications and no other company makes equipment compatible with the Monaco System. The upgrade must be compatible with the Monaco Enterprises D-21 Force Protection System currently installed and in use at the 4 th Fighter Wing. To upgrade the system compared to replacing the system is a savings of about $750,000.00. This cost is not expected to be recovered through full and open competition. If this system is not upgraded 4th Security Forces Squadron will not have the ability to track security forces patrol vehicle on the road causing a lack in officer safety. This is requiring pinpointing an officer location should they be incapacitated while on patrol. This requirement would minimize a current deficiency which currently exists for two (2) vehicles which do not currently have any system installed. This deficiency could seriously hamper the wing's ability to safely secure base vehicles. Without the system possible danger of damage or loss of government assets, and/or injury or loss of life to Air Force personnel could result from not having the additional systems. VI. EFFORTS TO OBTAIN COMPETITION : This system is proprietary to Monaco Enterprises. They do not have any authorized distributors for the required product or service. VII. FAIR AND REASONABLE COST : The Contracting Officer will make a price fair and reasonable determination following the procedures identified in FAR 13.106-3(a)(2). VIII. MARKET SURVEY : According to 4 th Security Forces technical representatives, and a letter from Monaco Enterprises, Inc. (see attached), this company has exclusive rights to manufacture, service, and repair all D-21 Force Protection systems (this includes all parts and specifications). No other company is able to provide parts, repair, service, or perform testing for this equipment. A sources sought synopsis was posted to the Federal Business Opportunities (FBO) website searching for companies who offer a vehicle tracking system that is compatible with the Monaco Enterprises D-21network based system already in place (see attached). No companies provided verification that they could accomplish this. IX. OTHER FACTS : N/A X. INTERESTED SOURCES : Monaco Enterprises Inc. XI. STEPS TO FOSTER COMPETITION : Market research will be conducted to see what other systems exist when the Monaco Enterprise System is due for replacement. If there are other cost effective options at that time the Government will explore those alternatives. XII. TECHNICAL REQUIREMENTS/PERSONNEL CERTIFICATION : The requesting activity has certified that the technical requirements are complete and accurate. XIII. CONTRACTING OFFICER’S CERTIFICATION : The Contracting Officer’s signature on the Justification Review Document represents certification that the justification is accurate and complete to the best of his/her knowledge.
