- JUSTIFICATION AND APPROVAL FOR EXCEPTION TO FAIR OPPORTUNITY 1. Contracting Activity:Department of Veterans Affairs Office of Acquisition Operations Technology Acquisition Center 260 Industrial Way West Eatontown, NJ 07724 2. Description of Action: This proposed action is for a Firm-Fixed-Price Delivery Order issued under the National Aeronautics and Space Administration (NASA) Solutions for Enterprise-Wide Procurement (SEWP) IV Government Wide Acquisition Contract (GWAC) for Samsung smart phones and tablets in support of Major Initiative Seven (MI7), New Models of Care (NMOC). 3. Description of Supplies or Services: The proposed action provides for the acquisition of six (6) Samsung Galaxy tablets with Wi-Fi and four (4) Samsung Galaxy smart phones. The Web & Mobile Solutions (W&MS) Program Office supports the VHA core business process of health care delivery and business intelligence work by facilitating the creation of web & mobile applications necessary for enhancing information solutions to current business problems while ensuring that solutions also meet the appropriate governance requirements of release. Through an arrangement between the VHA and the Office of Information Technology (OIT), responsibility for web & mobile applications development is shared between the two (2) offices. Products developed through W&MS will be targeted at specific mobile platforms, primarily Apple's iOS, Android and HTML5-enabled devices. The total estimated price of this proposed action is $XXXX. 4. Statutory Authority: The statutory authority permitting an exception to fair opportunity is Section 41 U.S.C. 253J (b) as implemented by the Federal Acquisition Regulation (FAR) Subpart 16.505(b) (2), entitled "Exceptions to the fair opportunity process", only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized. 5. Rationale Supporting Use of Authority Cited Above:The VA is currently developing mobile applications that will allow the beneficiary population to access VA services through mobile devices. In order to support the beneficiary population needs, the VA must ensure that these mobile applications support both a wide variety of devices as well as operating systems. The development and testing on vendor specific products is required to meet VA standards for safety, quality, development, usability, evaluations, interoperability, and training. It is necessary to develop, test and evaluate the mobile device brands which are most commonly used by the target demographic in an effort to fully validate and verify the operability, usability, safety, and quality of the mobile applications currently being developed. In addition to these devices the VA has selected a variety of other mobile device brands which comprise the majority of the market share in an effort to test those mobile devices that are most widely used by our beneficiary population. 6. Efforts to Obtain Competition: Market research was conducted, details of which are in the market research section of this document. This effort did not yield any additional sources that can meet the Government's requirements. There is limited competition anticipated for this acquisition. In accordance with FAR 5.301 and 16.505(b) (2), this action will be synopsized at award on the Federal Business Opportunities Page (FBO) and the justification will be made publicly available. 7. Actions to Increase Competition: The Government will continue to conduct market research to ascertain if there are changes in the market place that would enable future actions to be competed. 8. Market Research: The Government's technical experts conducted market research by reviewing Android based Phones. This market research was conducted in March of this year and is continuously being conducted. The Samsung brand of mobile products has been identified as an alternative to the most widely used, Apple brand products. Market reaserch showed that while Samsung does not command as large a share of the mobile device market as Apple, it commands a large share of the non-Apple mobile device market and is a moderately priced mobile alternative. Due to Samsungs market share command and moderate pricing, the Government Technichal experts anticipate that many VA beneficiaries are and will be using Samsung brand mobile devices, such as the Galaxy. Since the market research indicates that there multiple small business contract holders capable of providing the required hardware, a Request for Quote will be submitted to Groups B and C on the NASA SEWP IV GWAC; all proposals received will be evaluated and eligible for award. 9.
