Description
This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested and a written solicitation will not be issued. The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-6. The solicitation number is P12PS23612, and the solicitation is issued as a request for quotation (RFQ). This solicitation is a small business set-aside. The NAICS code is 212319 with an associated small business size standard of 500 employees. It is the contractor's responsibility to be familiar with applicable clauses and provisions. Clauses and provisions can be found at http://www.acquisition.gov/far. This solicitation will result in award of a firm, fixed-price contract. The National Park Service has a requirement to remove material from the banks of Finley Creek, within the boundary of Olympic National Park, to a previous crushing site, transport the material to that local site and crush the material into stockpiles. SITE VISIT: ORGANIZED SITE VISIT IS SCHEDULED FOR MONDAY, AUGUST 20, 2012 AT 12PM. The project site is located in the Quinault area of Olympic National Park. Finley Creek is located along the north shore road. Turn off of us highway 101 onto north shore road. Meet at the Finley Creek Bridge. Vehicles can be parked near west side bridge berms. Map of the park can be found on-line at http://www.nps.gov/olym, click on "directions" and then click on "maps." Below, in the scope of work, section 4 - Material Excavation & Transport, there is mention of "site 1" and "site 2." Sites 1 and 2 are located on east side of Finley Creek and will be shown and discussed during the site visit. Contractor will be required to haul out these two east side sites first, before hauling from the west side. Questions & Answers discussed during the site visit will be made available as a separate attachment to the solicitation via amendment to this solicitation. It shall be the contractor's responsibility to check for amendments. As stated in clause 52.237-1, site visit (included below in list of clauses), quoters are urged and expected to inspect the site where services are to be performed and to satisfy themselves regarding all general and local conditions that may affect the cost of contract performance, to the extent that the information is reasonably obtainable. In no event shall failure to inspect the site constitute grounds for a claim after contract award. SCOPE OF WORK. 1. GENERAL. The National Park Service has a requirement to remove material from the banks of Finley Creek, within the boundary of Olympic National Park, to a previous crushing site, transport the material to that local site and crush the material into stockpiles. The project site abuts a publicly accessed roadway, a bridge, and a stream channel. Work is under a permit with the U.S. Army Corps of Engineers. 1.1. REFERENCES. References herein to "WASHDOT section xxx" shall be deemed to refer to the latest printing of the Washington department of transportation standard specifications. 1.2. HOURS OF WORK. Work hours shall be strictly conformed to. For this project the start of work shall be no earlier than 7:00 a.m. and the end of work shall be no later than 6:30 p.m., Monday through Friday, excluding holidays. All vehicles shall be in the crushing and stockpiling yard not later than 6:30 p.m., or an alternative end-of-work time approved in writing by the Contracting Officer (CO). No weekend work shall be allowed. Variations may be granted by the CO in writing following written request by the contractor. Work must be halted, all equipment off site and full access established through the project at the time specified above. 1.3. CRUSHING & STOCKPILING YARD: The Contracting Officer's Representative (COR) will establish the location of a crushing and stockpile yard for the contractor. The perimeter of the yard shall be fixed. All materials shall be stockpiled in the construction yard. No materials or equipment may be left within the right of way or out of the yard outside of the hours of work. 1.4. VANDALISM: All work and equipment shall be protected against vandalism. Any damage resulting from vandalism shall be the Contractor's responsibility. 2. MOBILIZATION. The contractor shall mobilize equipment and materials to the site in preparation for beginning work. The contractor shall clean all equipment, including transportation equipment (i.e. Lowboys, crushing equipment), prior to mobilizing any piece of equipment to the site. The intent is to prevent the propagation of seeds of non-native vegetation into the site. The contractor shall not store any equipment or materials on any private parcel, business or residential, unless a written agreement between the owner of said parcel and the contractor, acceptable to the CO, is approved in advance by the CO. 2.1 SCALES. The contractor shall supply and place measuring scale(s) capable of measuring all material delivered to the site. The scale(s) shall certified by an independent agency or party, qualified in such certification and acceptable to the co. Weight tickets and records shall be maintained onsite. A copy of all weigh ticket will be furnished to the co for deliverables. 2.2 DEMOBILIZATION. The contractor shall remove all equipment from the site. The contractor shall grade ruts, contractor-generated debris, and other non-native materials from the roadway and site. All such materials shall become the property of the contractor and shall be removed from the park. 3. TRAFFIC CONTROL. Contractor shall furnish all labor, equipment and materials necessary to maintain traffic control including flagging, barricades, signs, markers and all incidentals as required by the NPS to ensure safe transport of river gravel over public roads to the crushing site. Traffic control shall conform to the applicable paragraphs of WASHDOT section 1-10 and the manual of uniform traffic control devices. The contractor shall submit in writing a traffic control plan delineating length, configuration, signing and duration, which shall be reviewed and approved by the COR prior to start of work on-site. 4. MATERIAL EXCAVATION AND TRANSPORT. 4.1 EXCAVATION. Rock materials shall be excavated from the Finley Creek stream bank berms as shown on the drawing. Excavation shall begin at site 1 and 2. As stated above, in the section of SITE VISIT, Sites 1 and 2 are located on east side of Finley Creek and will be shown and discussed during the site visit. Contractor will be required to haul out these two east side sites first, before hauling from the west side. The method and means of excavation will be the sole responsibility of the contractor within the limits of permitting. No work will be permitted within edge to edge of any flowing water. Material site 1 lies beyond material site 2. As it is the intent of this work to excavate materials first from site 1, the contractor will be required to build and maintain any necessary path, road or other access from the public roadway to material site 1, to access materials therein. The intent of this work is that material shall be excavated from existing rock berms nearby the roadway and bridge. Extensive travel up stream or downstream, except as necessary to achieve the necessary volume of material, is not anticipated. Final area product will leave berms tops even with top roadway of berm sloping naturally into creek channel. 4.2 TRANSPORTATION. Once excavated, rock materials shall be transported to the site identified for crushing and material handling. The method and means of transportation will be the sole responsibility of the Contractor within the limits of permitting. The Contractor will give right of way to private vehicles operating on the roadway. 4.3 MATERIAL CRUSHING. (A) Material delivered to the crushing site shall be weighed in advance of any processing. Written receipts indicating weight of all loads shall be maintained at the site. It shall then be processed into final product, sized as identified. All processes necessary to produce material sized and defined as indicated are the responsibility of the Contractor. (B) Final material produced shall be stockpiled by the Contractor in a pile near existing base course material indicated by CO. Stockpiles shall be maintained as a vertical stockpile and will not be allowed to spread a horizontal footprint beyond that necessary for the material's natural slump. (C) Material shall be produced according to the WASHDOT Section 9-03.9(3), Crushed Surfacing Base Course (NOT Top Course) with the following exceptions: (i) Percentage by weight passing the 1" sieve: 65%-100% (ii) Percentage by weight passing the No. 4 sieve: 15%-45% (iii) Percent fracture: 50% minimum (iv) The portion of crushed surfacing retained on a No. 4 sieve shall not contain more than 2 percent wood waste. 4.4 EARTHWORK. Earthwork shall include all work necessary for grading, excavation, borrowing, backfilling, and disposal of excess excavated materials as required for the complete performance of the work for the excavation of materials, delivery of the materials to the crushing site, and crushing, as specified herein, and discussed during the site visit. 4.5 WATERING. If necessary for use in the contractor's hauling and/or crushing operation, watering will be the sole responsibility of the contractor. 5. MAINTAINING ROADWAY DURING PROJECT. This project requires extensive travel on a public roadway. The Contractor shall be required to maintain the roads in a drivable condition. Extensive wheel rutting, deep trench edges and other hazards shall be repaired in a timely manner. If problems are identified to the contractor and not repaired in a timely manner, the project will be halted until such road repairs are made. 6. RE-GRADING AT END OF PROJECT. Upon completion of the work and following demobilization, the Contractor's final act shall be to re-grade the public roadway and access drive into the crushing site to a condition at least equal to what existed at beginning of work. Grading shall consist of cutting and filling as necessary to maintain the roadway in a smooth and drivable condition, including watering and compaction as necessary. 7. QUALITY ASSURANCE / INSPECTION. All work shall be inspected on an ongoing basis by the COR and/or assigned project inspectors. The contractor shall provide for and allow complete and unobstructed access to all work areas, processes and elements of the project. Contractor shall work closely with the COR to assure that adequate inspection and quality control is maintained. Failure to do so will result in an immediate stop of work, without compensation to the contractor for any delays encountered or claimed. End of scope of work. 8. COMPLETION TIMELINE/PERIOD OF PERFORMANCE: Work at the site shall not begin before September 17, 2012. All material transport and crushing work must be completed no later than February 28, 2013. De-mobilization may extend beyond that date. If the contracted quantity of material is not produced by February 28, 2013, the contractor will not be penalized in any way, including no liquidated damages applied. In such a case, at the sole discretion of the NPS, the project shall either be; (a) extended to allow the contractor to achieve the contracted quantity, or (b) the produced quantity as of February 28, 2013 shall be accepted as the final quantity. Only the quantity of material actually produced shall be measured and paid for. Uncrushed rock transported, but not crushed, shall not be paid for. PRICE SCHEDULE: The following line items shall be filled in and submitted with quote. The line items may be copied onto Quoter's letterhead or this page may be filled out and submitted with quote. So long as all line items are submitted, priced, the format does not matter. Quoters are encouraged to also provide a price breakdown in sufficient detail to support the lump sum amount quoted. "CLIN" means Contract Line Item. The government currently has $100,000 appropriated for this project. THIS AMOUNT IS NOT THE GOVERNMENT ESTIMATE. It is what the Government intends to spend. For this amount, the Government anticipates being able to purchase 1,750 tons, after mobilization and traffic control. CLIN0001: Mobilization/Demobilzation - - 1 Lump Sum $____________ CLIN0002: Traffic Control - - 1 lump sum $____________ CLIN0003: Material Excavation & Transport - - Qty ____________ tons x $____________ per ton = $____________ CLIN0004: Transport (hauling only) - - Qty ____________ tons x $__________ per ton = $____________ CLIN0005: OPTIONAL INCREASED QUANTITY IN INCREMENTS OF 500 TONS AT A TIME. If funds become available after award, then the Government intends to exercise this option for additional quantity, multiple times for as much as funds will allow, in increments of 500 tons at a time. Prices quoted for this optional line item shall remain firm, fixed price for duration of the contract. The Government will only exercise the option in increments of 500 tons at a time, per contract completion schedule as agreed by the parties. Material Excavation & Transport - - Qty ____________ tons x $____________ per ton = $____________. PAYMENT & POSSIBLE REQUIREMENT FOR CONTRACTORS TO REGISTER AT NEW INTERNET PAYMENT PLATFORM SYSTEM (IPP) AFTER AWARD OF CONTRACT 1. PAYMENT. Payment of approved invoices will be made on a net-30 basis, either by electronic funds transfer (direct deposit into contractor's bank account per contractor's SAM registration), or by Government Charge Card (vendor permitting). Payment shall be by actual completed quantities measured. Only completed work will be considered for payment. 2. IPP REGISTRATION MAY BE REQUIRED. The National Park Service is transitioning to a new electronic budget and acquisition software program during fall 2012, which will impact the way invoices are received, processed, and paid. This contract will be awarded just prior to the current system shutting down, and data migrating to the new system. As a result, during fall 2012 (which will be during the performance period of the awarded contract), the contractor MAY be required to submit "payment requests" electronically, through the U.S. Department of the Treasury's Internet Payment Platform System (IPP). "Payment Request" means a request for invoice payment by the Contractor. To constitute a proper invoice, the payment request must comply with the requirements of the clause at 52.212-4 Contract Terms and Condition-Commercial Items (listed below in "clauses and provisions"). The IPP website address is: https://www.ipp.gov. Contractor assistance with enrollment can be obtained by contacting the IPP Production Helpdesk via email ippgroup@bos.frb.org or phone (866) 973-3131. The Contractor Government Business Point of Contact (as was listed in CCR, which should now be listed in contractor's registration in SAM) will be receive enrollment instructions via email from the Federal Reserve Bank of Boston (FRBB) within 3 - 5 business days of the contract award date, only for awards made after September 4, 2012. For contracts awarded prior to September 4, 2012, the contractor MAY be required to register and use IPP, but details are not fully known at time of issuance of this solicitation. The Contracting Officer will provide further information after award. If the contractor is unable to comply with the requirement to use IPP for submitting invoices for payment, the contractor must submit a waiver request in writing to the contracting officer with its quotation (applicable to solicitations issued and contracts awarded after September 4, 2012 - PRIOR TO SEPTEMBER 4, 2012 A WAIVER IS NOT REQUIRED BUT CONTRACTOR IS HEREBY NOTIFIED IPP MAY BE REQUIRED AFTER AWARD). U.S. DEPARTMENT OF LABOR SERVICE CONTRACT ACT WAGE DETERMINATION is applicable to this solicitation, as listed below, and can be viewed in full text on-line at http://www.wdol.gov. Select "SCA WDs." Search by state (WA), then by county (Grays Harbor). Answer "yes" to previously performed. Answer "no" to non-standard services. Answer "no" to collective bargaining agreement. The wage determination number is 05-2559 (Revision no. 15 dated 06/19/2012), and is hereby incorporated into this solicitation. Award will be made on the basis of "best value" to the contractor that the Government determines can best satisfy the objectives and requirements of this Request for Quotations, in a manner most advantageous to the Government. Part 2 - WHEN AND WHERE TO SUBMIT QUOTE. Quotations must be received no later than August 24, 2012 at 4:00 p.m., Pacific Daylight Time.
