- THIS IS NOT A REQUEST FOR COMPETITIVE PROPOSALS. This is a notice of intent to award a sole source contract under statutory authority FAR 8.405-6(b)(1), "the acquisition is conducted under the authority of the Multiple Award Schedule Program" (see FAR 8.401) and FAR 8.405-6. (a)(2) United States Special Operations Command (USSOCOM), MacDill AFB, FL 33621, requires inspection of the Hydraulic Vehicle Barricade System. The 6th Contracting Squadron intends to make an award to Delta Scientific, 40355 Delta Lane, Palmdale, CA 93551. DEMONSTRATION THAT THE CONTRACTOR'S UNIQUE QUALIFICATIONS OR NATURE OF THE ACQUISITION REQUIRES THE USE OF THE AUTHORITY CITED ABOVE (APPLICABILITY OF AUTHORITY) The existing barricade systems within the HQ USSOCOM complex were all manufactured and installed by Delta Scientific Corp in 1996, at a cost of over $1M. The current contract is through NSWC Crane (government agency) and is due to expire on 30 September 2012. The equipment utilized is proprietary. The automated touch panel controls are programmed by Delta software engineers which include all operational and safety commands and is protected to prevent modifications and the protection of trade secrets and liabilities. Delta is recognized as the premier manufacturer of hydraulic barricades, with systems installed all over the world and at US Government facilities. Selecting Delta will ensure the continued validity of all warranties and the current quarterly service agreement between USSOCOM and Delta. Resource protection and personnel safety are paramount and will significantly degrade USSOCOM's force protection requirements at the headquarters if improperly serviced or maintained. Failure to have Delta perform these services will have a severe impact monetarily and can be a contributing factor for the cause of injuries or loss of life due to the need for Delta to be called upon if the barricades are serviced by any other manufacturer. The service Delta provides is critical in order to ensure the barricade controls are tested, synchronized, and certified for safe operation with the control panel's programming. The proposed contract action is for supplies or services for which the Government intends to solicit and negotiate with only one source under the authority of FAR 8.405-6(b(1). Interested persons may identify their interest and capability to respond to the requirement or submit proposals. This notice of intent is not a request for competitive proposals. However, all proposals received by Monday, 20 August 2012, 9:00 a.m. EST will be considered by the Government. A determination by the Government not to compete with this proposed contract based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement.
