Description
The Department of Commerce National Oceanic and Atmospheric Administration (NOAA)/Mission Support Division, Norfolk, VA is issuing notice of intent to negotiate a sole source procurement with to Marel Seattle, Inc for the calibration, maintenance, upgrade and repair of M100 scales. The purchase order shall be for one year with and two (2) one year option periods. Since Marel is the manufacturer of the scales, they are the only vendor capable of providing the required services. The required period of performance is September 1, 2012 through August 31, 2013 with two (2) one year option periods. The statutory authority is 41 US 253(c)(1), Only One Responsible Source. The government intends to award a firm-fixed price purchase order for this requirement. The Northeast Fisheries Observer Program's (NEFOP) data that are collected by observers and at-sea monitors, is used in management of quotas, total allowable catch limits and monitoring/management of fishery management plans. Data continuity is critical to NEFOP data collection and to have another vendor work on the instruments would void all warranties and commitments regarding the functionality of the scales. The scales are already in use and have been serviced by Marel and changes to data continuity would be detrimental to NOAA's mission to provide accurate catch weight data. Any warranty or performance issues with these scales would put the Government at a severe disadvantage if another contractor were to provide the required services. The proposed contract action is for services for which the Government intends to solicit and negotiate with only one source under the authority of FAR 6.302(c)(1). The applicable NAICS code is 333997. Interested parties may submit a capability statement, proposal, or quotation, which shall be considered by the agency. Responses shall be submitted by 11:00 a.m. Eastern Standard Time, August 15, 2012. This notice of intent is not a request for competitive proposals.
