- •1. Contracting Agency : This limited-source justification was prepared by the Federal Communications Commission, Headquarters; Office of the Managing Director, Administrative Operations, Contracts and Purchasing Center. •2. Description of Action : Federal Supply Schedule (FSS) order for supplies not requiring a statement of work. A firm fixed price order shall be placed with SAP Government Support and Services, Inc., Newtown Square, PA. •3. Description of Supplies/Services : The awarded purchase order-contract will provide service and support for Sybase for one year. •4. Statutory Authority Cited : FAR 8.405-6 (a)(1)(i)(B) "Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized.." A determination by the Contracting Officer that the order represents the best value consistent with FAR 8.404(d) : SAP has a unique combination of features that meet the requirements. SAP is the only source of Sybase maintenance as a GSA reseller and provides the best overall value to the government. SAP provided a quotation that is less than fair market value (based on the Federal Supply Schedule price), resulting in a price to the FCC of $446,230.07. Based on this information the contracting officer has deemed this to be a fair and reasonable price. In addition FAR 8.404 (d) states " GSA has already determined the prices of supplies and fixed-price services, and rates for services offered at hourly rates, under schedule contracts to be fair and reasonable. Therefore, ordering activities are not required to make a separate determination of fair and reasonable pricing," thereby representing the best value to the government. •6. Market Research : The instrument is offered on the GSA Schedule. The unit pricing can be considered a "competitive procedure" under CICA when the GSA Schedule ordering procedures are followed (See FAR 6.102(d)(3)). A market survey was conducted to identify all possible GSA reseller vendors of Sybase maintenance with the required features. •7. Other Factors : This procurement action is required to facilitate the FCC Information Technology Center's technical capabilities. The FCC currently has Sybase software and maintenance (backup/recovery, monitoring and administrative solutions) currently in place with existing Sybase infrastructure. To use another manufacturer would require changes to the FCC IT infrastructure that would be cost prohibited. •8. Efforts to Obtain Competition : A manufacturer with similar capabilities that would provide similar Sybase maintenance has not been found.
