- Combined Synopsis/Solicitation posting RFQ-DC-12-00052 ? ENERGY STAR On-Line Store: Plaques, Decals, Flags & Banners NAICS code: 453998 The US EPA/OAR/OAP/CPPD (Climate Protection Partnerships Division), under the authority of 31 U.S.C. ? 6303 and in accordance with the 41 U.S.C. ? 253, Competition in Contracting Act (CICA), is soliciting contractors interested in entering into one ?no-cost? or ?Gratuitous services? contract to produce and sell plaques, decals, flags & banners bearing an ENERGY STAR logo ONLY TO owners of qualifying commercial buildings and manufacturing plants (hereafter referred to as buildings/facilities). ENERGY STAR is the mark of superior energy performance and identifies a building/facility as one of the most energy-efficient buildings/facilities in the nation. As such, owners of buildings/facilities that qualify may display their achievement by purchasing a plaque, decal, flag or banner for their qualifying building/facility. This contract will be the official agreement between EPA and ONE contractor to produce these approved items, and sell to owners of qualified buildings/facilities (as determined by EPA). The contract will include the following statements, requiring the contractor?s consent to the same: In consideration of the right to produce and distribute the ENERGY STAR recognition items under Contract No. TBD, the undersigned contractor hereby expressly agrees to provide the subject services to the United States Environmental Protection Agency without charge or ?gratuitously.? It is understood and agreed that the contractor will provide the aforementioned services free of charge to the United States Environmental Protection Agency and that no future compensation or claim related to said services will be due or expected. It is also understood and agreed that this Agreement in no way amends or modifies the Terms and Conditions of Contract No. TBD. This Agreement does not violate the prohibition against ?voluntary services? contained in 31 U.S.C. ? 1342 in that services furnished pursuant to a formal agreement are not considered voluntary services. 7 Comp. The full Statement of Work (SOW), with further information on the ?no-cost? contract including the Instructions to Respond can be found at the following website: http://www.epa.gov/oamhpod1/admin_placement/1200052/index.htm Interested contractors should prepare their response based upon the information included in the SOW and the Instructions to Respond. Responses should be no more than four double-sided pages (eight pages total ? excluding pricing) in length and should describe in detail the contractor?s capabilities as required in the SOW. Please include your company name, point of contact, address, e-mail address, area code & phone number, DUNS number, proof of registration in the Central Contractor Registration, and business size & classification (e.g., woman or minority owned; 8(a), etc.). Telephone requests or inquiries will not be accepted. Although the Federal Acquisition Regulation (FAR) applies to Federal acquisitions using appropriated funds, the resulting contract of this RFQ will be at no cost to the Government, but following Commercial Items provisions/clauses will be included as part of the resulting no-cost contract: FAR 52.212-3 ?Offeror Representations and Certifications-Commercial Items;? FAR 52.212-4 ?Contract Terms and Conditions-Commercial Items;? as applicable, FAR 52.212-5 ?Contract Terms and Conditions Required to Implement Statutes or Executive Orders-Commercial Items;? FAR 52.227-14 ?Rights in Data General?; FAR 52.217-8 ?Option to Extend Services?; FAR 52.217-9 ? Option to extend the Term of the Contract?; EPAAR clause 1552.209-70 ?Organizational Conflict of Interest Notification?; and EPAAR clause 1552.209-71 ?Organizational Conflict of Interest?.
