- Department of Labor Wage Determination Amendment No. Two Amendment No. Two (2) is herby issued to Solicitation No. 12-247-SOL-00073 as follows: 1.Extend the Period of Performance to August 7, 2012 with same RFQ submission time of 12:00PM. 2.Remove FAR Clause 52.219, Limitations on Subcontracting (11/11) from the solicitation. 3.Vendors can submit option price per square foot for additional panel removal. 4.Add the following to the Scope of Work (SOW): 310 Ft. textured drywall to be removed from Building 6 (Attachment A). 5.Remove Far Clause 52.216-8, Option to Extend Services (Nov 1999), 52.222-41, Service Contract Act of 1965, as amended (Nov 2007) from Page 16 of the solicitation. 6.Add the following to Section B, under Materials, on Page 6: The Contractor shall submit to the Designated Project Officer, copies of signed receipts from the approved permitted landfill operator of receipt of material at the permitted landfill clearly indicating the following: a) Date b) Time c) Amount of material received d) Authorized person's signature from permitted landfill e) Name and address of transporter f) Driver's signature g) Name and address of permitted landfill operator h) Date and time material is to be land filled Submit written evidence that the landfill(s) for disposal are approved for asbestos and any other hazardous materials disposal by the USEPA and state or local regulatory agency(s). Submit uniform hazardous waste manifests prepared, signed and dated by an agent of the landfill. The manifest must certify the amount of hazardous materials delivered to the landfill. The manifest must be provided to the Indian Health Service within ten working days after delivery. 7.Add the following to Section F., Deliverables, on Page 9: The Contractor shall submit to the Designated Project Officer, copies of signed receipts from the approved permitted landfill operator of receipt of asbestos material at the permitted landfill. The Contractor shall submit uniform hazardous waste manifests prepared, signed and dated by an agent of the landfill. The manifest must certify the amount of hazardous materials delivered to the landfill. The manifest must be provided to the Indian Health Service within ten working days after delivery. 8.Add the following to the Scope of Work: POST AWARD CONFERENCE (a) A post award conference with the successful offeror is required. It will be scheduled within 5 days after the date of contract award. The conference will be held at: Phoenix Indian Medical Center, Engineering Department unless otherwise changed by mutual agreement. (b) Contractor designated representative or foreman (whomever the Contractor will have on the site) shall be present at the prework conference. COMMENCEMENT, PROSECUTION AND COMPLETION OF WORK (FAR 52.211-10) (APR 1984) The Contractor shall be required to (a) commence work under this contract within 10 calendar days after the date the Contractor receives the notice to proceed, (b) prosecute the work diligently, and (c) complete the entire work ready for use not later than 14 days after notice to proceed. 9.Add the following to the Solicitation: DEPARTMENT OF LABOR: No contractor or subcontractor holding a service contract for any dollar amount shall pay any of its employees working on the contract less than the minimum wage specified in section 6(a)(1) of the Fair Labor Standards Act (29 U.S.C. 206). The Department of Labor, Wage and Hour Division has issued a Wage Determination for laborers to be employed under this purchase order. Wage Determination No. DOL WD AZ120037 (07/20/2012 AZ37) is incorporated into this purchase order pursuant to Federal Acquisition Regulation (FAR) 22.1108-2. (Refer to Attachment 1). In addition, to paying employees appropriate hourly wages the contractor is responsible for fringe benefits applicable to all classes of service employees engaged in purchase order performance. Fringe benefits are not included in the hourly wages. 10.Revise Section K, Method of Payment and Invoice Submission, as follows: a) Payment shall be made in arrears; b) Electronic Funds Transfer (EFT) shall be utilized as method for processing payment; c) Upon receipt of the Contractor's properly prepared invoice, the Project Officer is responsible for certifying the invoice for acceptance of service and contacting a UFMS receiver to request a receiving receipt. d) Improperly prepared invoices will be returned to the Contractor resulting in delayed payment. The following shall constitute as a "properly" prepared invoice: 1. Invoice containing activity with no missed period; 2. Purchase Order number and Period of performance; 3. Fee schedule of line items, description, quantity, unit of price and extended total per line item; Total amount of invoice. Original invoice shall be submitted to: Phoenix Indian Medical Center Attn: Finance Department 4212 N. 16th Street Phoenix, AZ 85016 Final payment, constituting the entire unpaid balance of the Purchase Order price, shall be made to the vendor when work has been completed. e) In addition to the address state above an electronic (PDF) copy shall be transmitted via email to the Project Officer at the following address: Jason.Lindner@ihs.gov. 11.Add the following to the Solicitation: The Contractor shall submit a detailed written Safety Action Plan to be used during the performance of Asbestos/Abatement. 12.Add the following FAR Clauses to the Solicitation: FAR 52.236-6 - Superintendence by the Contractor (Apr 1984) At all times during performance of this contract and until the work is completed and accepted, the Contractor shall directly superintend the work or assign and have on the worksite a competent superintendent who is satisfactory to the Contracting Officer and has authority to act for the Contractor. FAR 52.236-7 - Permits and Responsibilities (Nov 1991) The Contractor shall, without additional expense to the Government, be responsible for obtaining any necessary licenses and permits, and for complying with any Federal, State, and municipal laws, codes, and regulations applicable to the performance of the work. The Contractor shall also be responsible for all damages to persons or property that occur as a result of the Contractor's fault or negligence. The Contractor shall also be responsible for all materials delivered and work performed until completion and acceptance of the entire work, except for any completed unit of work which may have been accepted under the contract. FAR 52.236-12 - Cleaning Up (Apr 1984) The Contractor shall at all times keep the work area, including storage areas, free from accumulations of waste materials. Before completing the work, the Contractor shall remove from the work and premises any rubbish, tools, scaffolding, equipment, and materials that are not the property of the Government. Upon completing the work, the Contractor shall leave the work area in a clean, neat, and orderly condition satisfactory to the Contracting Officer. FAR 52.236-13 -- Accident Prevention (Nov 1991) (a) The Contractor shall provide and maintain work environments and procedures which will -- (1) Safeguard the public and Government personnel, property, materials, supplies, and equipment exposed to Contractor operations and activities; (2) Avoid interruptions of Government operations and delays in project completion dates; and (3) Control costs in the performance of this contract. (b) For these purposes on contracts for construction or dismantling, demolition, or removal of improvements, the Contractor shall -- (1) Provide appropriate safety barricades, signs, and signal lights; (2) Comply with the standards issued by the Secretary of Labor at 29 CFR Part 1926 and 29 CFR Part 1910; and (3) Ensure that any additional measures the Contracting Officer determines to be reasonably necessary for the purposes are taken. (c) If this contract is for construction or dismantling, demolition or removal of improvements with any Department of Defense agency or component, the Contractor shall comply with all pertinent provisions of the latest version of U.S. Army Corps of Engineers Safety and Health Requirements Manual, EM 385-1-1, in effect on the date of the solicitation. (d) Whenever the Contracting Officer becomes aware of any noncompliance with these requirements or any condition which poses a serious or imminent danger to the health or safety of the public or Government personnel, the Contracting Officer shall notify the Contractor orally, with written confirmation, and request immediate initiation of corrective action. This notice, when delivered to the Contractor or the Contractor's representative at the work site, shall be deemed sufficient notice of the noncompliance and that corrective action is required. After receiving the notice, the Contractor shall immediately take corrective action. If the Contractor fails or refuses to promptly take corrective action, the Contracting Officer may issue an order stopping all or part of the work until satisfactory corrective action has been taken. The Contractor shall not be entitled to any equitable adjustment of the contract price or extension of the performance schedule on any stop work order issued under this clause. (e) The Contractor shall insert this clause, including this paragraph (e), with appropriate changes in the designation of the parties, in subcontracts. Alternate I (Nov 1991). If the contract will involve (a) work of a long duration or hazardous nature, or (b) performance on a Government facility that on the advice of technical representatives involves hazardous materials or operations that might endanger the safety of the public and/or Government personnel or property, add the following paragraph (f) to the basic clause: (f) Before commencing the work, the Contractor shall -- (1) Submit a written proposed plan for implementing this clause. The plan shall include an analysis of the significant hazards to life, limb, and property inherent in contract work performance and a plan for controlling these hazards; and (2) Meet with representatives of the Contracting Officer to discuss and develop a mutual understanding relative to administration of the overall safety program. FAR 52.236-26 - Preconstruction Conference (Feb 1995) If the Contracting Officer decides to conduct a preconstruction conference, the successful offeror will be notified and will be required to attend. The Contracting Officer's notification will include specific details regarding the date, time, and location of the conference, any need for attendance by subcontractors, and information regarding the items to be discussed. 13.Offers must acknowledge receipt of this amendment prior to the hour and date specified in the solicitation or as amended, by completing Items 8 and 15, and returning One (1) copie of the amendment in the attached PDF File entitled "Amendment No. Two".
