- NOTICE OF PROPOSED CONTRACT ACTION (NOPCA). This is a notice of intent to award a sole source contract under statutory authority 10 USC 2304(c)(1), as implemented by FAR 6.302-1, Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements. The Government intends to award a Firm-Fixed-Price and Time and Materials contract for the purchase of KS-252 production units, maintenance (repair), software modifications, and technical support. The Government intends to make award to the Original Equipment Manufacturer (OEM) ViaSat Inc., 6155 El Camino Real, Carlsbad, CA 92009-1602, CAGE CODE: 47358, NAICS: 334290. THIS IS NOT A REQUEST FOR COMPETITIVE PROPOSALS. This is a notice of intent. The Air Force does not have complete technical data or technical expertise to compete this requirement. A determination not to compete this requirement is within the discretion of the Government. Any response to this notice must show clear and convincing evidence that competition would be advantageous to the Government in future procurements. The Government intends to make an award by November, 2012. If a firm believes it is capable of meeting the Government's requirement, it may identify their interest and capability to the Contracts Specialist within fifteen (15) days of this publication. Those interested firms must indicate whether they are a large, small, small-disadvantaged, 8(a), or women owned business and whether they are U.S. or foreign owned. Any responses to this NOPCA shall be submitted to the Contracts Specialist, Mr. Ivy Furnace, at ivy.furnace@us.af.mil. Telephone requests or inquiries will not be accepted. See Note 22.
