Description
The U.S. Army Contracting Command-New Jersey, on behalf of Project Manager Soldier Weapons (PM-SW), intends to solicit, negotiate, and award a sole source modification to Kongsberg Defence & Aerospace (KDA) under the authority of 10 U.S.C. 2304(c)(1) as implemented by FAR 6.302-1(a)(2)(ii) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirement regarding the M134 Weapon Adapter Kit(WAK) for the Common Remotely Operated Weapon Station (CROWS) provided by Kongsberg Defence and Aerospace. The anticipated effort will be a Firm Fixed Priced (FFP) Modification to Contract # W15QKN-09-C-0168 that will increase the ceiling by $11.8M. The acquisition of CROWS M134 WAK Kits from sources other than Kongsberg Defense and Aerospace will not meet the schedule requirements. It is likely that award to any other source would result in unacceptable delays in meeting PM CSW's requirements as a result of the unacceptable lead times from contract award to the services rendered. The potential new source would have to manufacture CROWS M134 WAK Kit that would function both reliably and safely. Failure to meet this timeline will result in a detrimental impacts to mission readiness and Warfighters' safety. KDA is the only source able to meet the Government's CROWS requirements of these M134 WAK Kits without disclosing KDA's proprietary design. Please note this notice DOES NOT constitute a Request for Proposal (RFP). A determination by the Government not to compete this proposed contract action based upon the responses to this notice is solely within the discretion of the Government.
