Description
DEPARTMENT OF VETERANS AFFAIRS Justification and Approval For Other Than Full and Open Competition 1.Contracting Activity: Department of Veterans Affairs, Program Contracting Activity Central (PCAC) 6150 Oak Tree Blvd., Suite 300 Independence, OH 44131. 2.Nature and/or description of the action being approved. This action is for the promotion and outreach in support of VA priorities to facilitate aggressive My HealtheVet/Blue Button enrollment/registration and Secure Messaging initiative to take place from May - September 2012. 3.A description of the supplies or services required to meet the agency's needs The contractor will be conducting a taped panel discussion comprised of Department of Veterans Affairs (VA) leaders, innovators and super users. The panel discussion will be moderated by a News Radio expert and the topic will be centered around the My HealtheVet, Secure Messaging, and VA Blue Button initiatives, along with other online access programs available to Veterans and Active Duty Armed Forces Service Members in order to inform, educate and promote the My HealtheVet, Secure Messaging, and VA Blue Button initiatives and to increase enrollment and registration, enhance education and awareness, and call the target audience to action. 4.An identification of the statutory authority permitting other than full and open competition. FAR 6.302-1 Only one responsible source and no other supplies or services will satisfy agency requirements; 41 U.S.C. 253(c)(1). In this procurement, Hubbard Radio Washington DC, a Small Business, is the only outlet that has the niche audience for the targeted audiences of Veterans, Service Members (active duty, retired and Federal workforce) with the specific package offering professionally taped/produced panel discussions that are excerpted to maintain as post-use packaging that can be dispersed and shared throughout other markets within the VA catchment markets, specifically those in the pilot sites (Miami, Roseburg, Memphis, Salt Lake City, Jesse Brown/Chicago) using a unique purchasing option which allows development of multiple Military and Federal Markets. 5.A demonstration that the proposed contractor's unique qualifications or the nature of the acquisition requires use of the authority cited. The outlet offers a panel interview discussion that is professionally moderated, in studio, which is then aired as a 52 minute on-air show on Federal News Radio on a mutually agreed upon date and packaged as online options which link directly to www.myhealth.va.gov. Thereafter, there are radio/on-air and online campaigns that take the "best of" from the panel and aired as a promotional/outreach series on WTOP and Federal News Radio and subsequent, local markets as designed. This campaign is designed to generate increased awareness for the My HealtheVet, VA Blue Button and associated projects and benefits. 6.A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by Subpart 5.2 and, if not, which exception under 5.202 applies. On April 23, 2012, an Intent to Sole Source was posted to FedBizOpps allowing contractors to respond with their capabilities. Also, a competing radio station with a similar target audience was contacted. 7.A determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable. The Contracting Officer performed the required analysis to ensure that the price was fair and reasonable. The analysis included a comparison of the proposed price and Independent Government Cost Estimate (IGCE). 8.A description of the market research conducted (see Part 10) and the results or a statement of the reason market research was not conducted. An intent to Sole Source was posted which allowed contractors to respond with their capabilities. Also, a competing radio station with a similar target audience was contacted but had limited capabilities in terms of reaching the target audience located in multiple markets across the country. VetBiz and Small Business Administration Dynamic Small Business database searches were conducted but did not reveal any Service Disabled Veteran Owned Small Businesses (SDVOSBs), Veteran Owned Small Businesses (VOSBs) or any other small business category capable of providing radio production and distribution to the target audiences in the Washington DC area and markets across the country. 9.Any other facts supporting the use of other than full and open competition, such as: Hubbard Radio Washington DC is a unique organization that has a niche target audience in multiple markets which complements the target of this campaign which includes Veterans, Service Members, Active Duty and Federal employees. It is the largest and most well known station for these targets. 10.A listing of the sources, if any, that expressed, in writing, an interest in the acquisition. There are no other capable sources that expressed in writing an interest in the acquisition. 11.A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required. To remove or overcome barriers to competition in the future, the Contracting Officer will work with the Program Office to continually conduct market research and develop requirements in order to promote competition to the maximum extent practicable.
