- Justification for Brand Name Products, Limited Source Justification 23 July 2012 Project: Respiratory Protection Program / Self Contained Breathing Apparatus (SCBA) parts From: National Park Service / Yellowstone National Park Structural Fire Department TO: Yellowstone National Park Contracting Office 1.Description of the action being approved: Sole Source / Name Brand Justification purchase of SCOTT SCBA parts to repair and perform maintenance on breathing apparatus. Yellowstone National Park Structural Fire Department utilizes SCOTT positive-pressure SCBA. The SCBA is a respiratory protection system worn by Fire Department personnel to provide breathable air in environments that are immediately dangerous to life and health. 2.Description of supplies and services: QuantityPart #Description 420016-03Heads-up Display (HUD) hoses w/wiring 6200187-02HUD Driver Module Assembly 4200189-01HUD Driver Battery Cover 1057264-00Teflon Gasket for SCBA Cylinder fittings 3.Authority: a.41 U.S.C. 253(c)(1): Only one responsible source and no other supplies or services will satisfy agency requirements. b.FAR Part 11.105: The Brand Name products are essential to the Government's requirements, and market research indicates other companies' similar products do not meet and cannot be modified to meet the agency's needs. c.FAR 6.302-1: The use of the name brand products are essential to the Government's requirements, thereby precluding consideration of a product manufactured by another company. 4.The description of the product's unique qualifications or the unique nature of the acquisition: The Yellowstone National Park Structural Fire Department utilizes Scott manufactured SCBA. There is a dire need for current out-of-service SCBA equipment to be operational with the new equipment being procured. If another manufacturer's equipment is attached to the currently equipment this would be considered an alteration and would negate the equipment's warranty, certifications and National Fire Protection Association (NFPA) / NIOSH regulations / standards. Other manufacturers of SCBA equipment do exist; but one manufacturer's equipment is not interchangeable with another manufacturer's equipment due to design and proprietary devices. Different manufacturer's equipment would not interface properly with parts from another company. 5.Description of the market research conducted: Determination that costs will be fair & reasonable: The SCOTT Main Distributor Service Center is a fixed price supplier of parts for repair and maintenance. The SCOTT Main Distribution Center is the only contractor listing GSA Advantage pricing selling the needed parts for maintenance. The Regional Service Center Authorized distributor's price differences reflect non-GSA pricing and charge accordingly by the location of the Distribution Service Center and applicable tax and shipping & handling charges 6.Other facts supporting other than full & open competition: In accordance with NFPA 1852 Standard on Selection, Care and maintenance of Open-Circuit Self Contained Breathing Apparatus, Chapter 5; Paragraph 5.1.4 "The organization shall ensure that SCBA interfaces properly with other personal protective items already being used by the organization." Additionally, using equipment from other manufacturers would void the NFPA and NIOSH certification. NFPA 1981 Standard on Open-Circuit Self Contained Breathing Apparatus for Emergency Services, Chapter 4, Certification, defines the certification process and governing agencies for SCBA maintenance certification. 7.Interested Sources: SCOTT Safety 4320 Goldmine Road Monroe, NC 28110 Tax ID#: 521297376 GSA Contract #: GS-07F-9563G 8.Certifications: a.Technical / Requirements Certification: "I do hereby recommend the use of the Brand Name products noted above for the procurement noted above.
