- The U.S. Food and Drug Administration (FDA) intends to award contracts to private Contractors for the purpose of inspecting retailers that sell tobacco products that fall under the scope of the following provisions: 1) The Federal Food, Drug and Cosmetic Act (FD&C Act); 2) The Comprehensive Smokeless Tobacco Health Education Act of 1986 (CSTHEA); and 3) The reissuance of the 1996 final rule entitled "Regulations Restricting the Sale and Distribution of Cigarettes and Smokeless Tobacco to Protect Children and Adolescents" pursuant to the Family Smoking Prevention and Tobacco Control Act. The Contractor shall conduct retail inspections for compliance with certain provisions of these regulations on behalf of the FDA. The purpose of this contract is to enforce the provisions cited above with respect to tobacco retailers in those U.S. States and Territories (jurisdictions) that have not contracted with the FDA to conduct retail compliance check inspections by: 1) Conducting inspections of retailers that sell and advertise regulated tobacco products to determine compliance with the provisions cited above and submitting observations and inspection results to the FDA; 2) Collecting, documenting, and preserving evidence of inspections and investigations; 3) Supporting the FDA in any enforcement or judicial actions, including coordinating the drafting and execution of declarations by the Inspectors and narrative reports by the Inspectors and Minors who participated in inspections, arranging for their testimony, if necessary, and furnishing evidence; 4) Coordinating with the FDA on responses to press inquiries and press announcements on the FDA Tobacco Retail Inspection Program and its results; and 5) Responding to inquiries by the FDA concerning inspections, data, and other information associated with this program. The FDA intends to award multiple contracts under this Request for Proposals. Each contract shall be to inspect at least one U.S. State or Territory that does not have a FDA Tobacco Retail Inspection Program contract.
