- JUSTIFICATION AND APPROVAL FOR AN EXCEPTION TO FAIR OPPORTUNITY 1.Contracting Activity: Department of Veterans Affairs (VA) Office of Acquisition and Logistics Technology Acquisition Center 260 Industrial Way West Eatontown, New Jersey 07724 2.Description of Action: The proposed action is for a firm-fixed-price delivery order issued under the National Aeronautics and Space Administration (NASA) Solutions for Enterprise-Wide Procurement (SEWP) IV Government-Wide Acquisition Contract (GWAC) for 45 Apple iPad 3 devices and accessories for the Major Initiative (MI)16 - Health Management Platform. 3.Description of Supplies or Services: The Department of Veterans Affairs (VA) requires the acquisition of 45 Apple iPad 3 devices and associated accessories for the MI16- Health Management Platform for development and testing purposes. These devices will be used for development work and functionality testing for specific application suites. MI 16 is responsible for all the informatics development work and are requesting these devices for the following development projects: Team Facing (clinician's application for patient health records), Patient Facing (patient application allowing direct access to their health records) and Pilot Test Sites (testing of team and patient facing applications). These devices will not be used for general access and will only be used for the above development projects. The total estimated price of the proposed action is 4.Authority Cited: The statutory authority permitting this exception to fair opportunity is 41 U.S.C. 4106(c) as implemented by the Federal Acquisition Regulation (FAR) Subpart 16.505(b)(2)(i)(B) entitled, "Only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized." 5.Rationale Supporting Use of Authority Cited: Memorandum dated 30 September 2011, "Support for Next Generation Mobile Computing" signed by Roger Baker, VA Chief Information Officer (CIO), identifies Apple iPads as the next generation of Mobile Computing for VA. These Apple iPads must conform to Federal Information Processing Standards (FIPS) 140-2 certified encryption. VA Office of Information and Technology (OIT) Enterprise Systems Engineering (ESE) Enterprise Security Solutions Service (ESSS) has recommended the iPad 3 for this effort since it is in the process of FIPS 140-2 certification. This procurement supports the initial test of mobile devices that will be rolling out this summer. The Apple iPad devices are the only devices to date that have been approved by Roger Baker, VA CIO for testing and development. The initial deployment of the team and patient health management platform applications is VA's proprietary version similar to the "Apple App-Store" which will only work on Apple iPads. The procurement of Apple iPad 3 devices will allow for the initial development and test of mobile devices for MI 16 software applications suites. Without Apple iPads, MI 16 will be unable to maintain schedule for the development and testing of these iPads on the Health Management Platform applications. 6.Efforts to Obtain Competition: Market research was conducted, details of which are in the market research section of this document. In accordance with the FAR 5.202 (a)(6), this effort is exempt from pre-award synopsis since the proposed contract action is an order placed under an existing Indefinite Delivery/Indefinite Quantity contract. However, in accordance with FAR 5.301 and FAR 16.505(b)(2), this action will be synopsized at award on the Federal Business Opportunities Page (FBO) and the justification will be made publicly available. 7.Actions to Increase Competition: In order to remove or overcome barriers to competition in future acquisitions for this requirement, the Government's technical experts will continue to perform market research to determine if there are any products available that will enable future requirements to be competed. 8.Market Research: Market Research was conducted in May 2012 to determine whether other brand name tablets could meet the Government's requirements. While there are other brands of tablets available (i.e. Blackberry, Acer, Toshiba, and Motorola), none of these tablets have been recommended and tested extensively by OIT ESE ESSS. Further market research was conducted utilizing the NASA SEWP IV Product Verification and Manufacturer Lookup tool and it was determined that there are six (6) potential resellers as follows: one (1) Value-Added Reseller (VAR) and Original Equipment Manufacturer (OEM), one (1) Service-Disabled Veteran-Owned Small Business set-aside (SDVOSB) VARs, two (2) Small Business set-aside VARS, and two (2) VARs. As a result, the research determined there is adequate competition among the resellers. Per the terms of the NASA SEWP IV contract, requirements for brand name specific equipment should be solicited to all four (4) contract groups (A, B, C and D) in order to fully notify all interested parties. However, since there is adequate competition among small businesses, quotes will only be accepted from Groups B (service-disabled veteran-owned small businesses) and C (small businesses). 9.Other Facts: None
