- Justification for Other Than Full and Open Competition NOAA's Acquisition & Grants Office, Western Acquisition Division - Boulder, intends to negotiate, on a sole source basis, under the authority of 41 USC 253(c)(1) - Only one responsible source, with Biomark Incorporated., to complete the development of a full-duplex (FDX)-B Passive Integrated Transponder (PIT-tag) system for spillway applications. NOAA believes it to be in the best interest of the Government to issue a sole source award to Biomark Incorporated. Biomark was awarded the initial contract for development of the spillbay transceivers in 2008. They have a viable solution close to completion, and award of this follow-on requirement will enable them to deliver a completed transceiver system to NMFS. Although there may be additional firms capable of developing a transceiver system, NOAA does not believe they will be able to do so in a competitive manner. Biomark has been working on these transceivers since 2008, and has already absorbed most of the cost associated with the products development. Any firm looking to compete with Biomark would have to start from the beginning, would be at a severe disadvantage, and would be unable to provide a competitively priced proposal. This Notice of Intent is not a request for competitive proposals and no solicitation package is available. However, firms that believe they can competitively provide the required services that fully meet the Government's requirements may submit substantiating documentation in writing to the identified point of contact within 15 days after publication of this synopsis. Such documentation will be evaluated solely for the purpose of determining whether or not to conduct this procurement on a competitive basis. A determination by the Government not to conduct a competitive procurement, based upon responses to this notice, is solely within the discretion of the Government. Oral communications are not acceptable in response to this notice.
