- LIMITED SOURCES JUSTIFICATION ORDER >$3,000 FAR PART 8.405-6 2237 Transaction # or Vista Equipment Transaction #: Hines Illinois VAMC, 578-12-3-6098-1091 This acquisition is conducted under the authority of the Multiple Award Schedule Program. The material or service listed in par. 3 below is sole source, therefore, consideration of the number of contractors required by FAR Subpart 8.4 - Federal Supply Schedules, is precluded for the reasons indicated below. (1) AGENCY AND CONTRACTING ACTIVITY:Department of Veterans Affairs Clement J Zablocki VAMC 5000 W National Ave Milwaukee, WI 53295 VISN: 12 (2) NATURE AND/OR DESCRIPTION OF ACTION BEING APPROVED: Emergency Urgent and Compelling, Direct Patient Care FAR 6.302-2 This is a onetime Firm Fixed Price rental for rental (installation and removal after rental) of an air cooling unit in a direct patient care area. Main unit does not work and second unit is leaking fluid. Estimated rental while main units are being repaired Is June-Apx. Sept. 2012. (3)(a)A DESCRIPTION OF THE SUPPLIES OR SERVICES REQUIRED TO MEET THE AGENCY'S NEED: 100 ton chiller rental (installation and removal after rental) for air cooling in direct patient care area. (b)ESTIMATED DOLLAR VALUE: $78, 460.00 (c)REQUIRED DELIVERY DATE: June 22,2012 IDENTIFICATION OF THE JUSTIFICATION RATIONALE (SEE FAR 8.405-6), AND IF APPLICABLE, A DEMONSTRATION OF THE PROPOSED CONTRACTOR'S UNIQUE QUALIFICATIONS TO PROVIDE THE REQUIRED SUPPLY OR SERVICE. xAn urgent and compelling need exists, and following the ordering procedures would result in unacceptable delays. FAR6.302-2. Two chillers in a direct patient care areas need repair. Back up unit is leaking cooling fluid and one does not function at all. Units have a large not standard combined tonnage cooling capacity. 120 tons. Aff-Mcquay has a chiller for lease with a large enough capacity to meet the minimum requirement, has the equipment required for installation of the unit, and can have the unit installed within two days. The chillers not functioning have a 120 ton combined capacity. Aff-Mcquay has a 100 ton unit which will meet the minimum requirements until the VA units are repaired. Two other suppliers were contacted; they could not meet the required tonnage capacity. Time is critical with summer heat and humidity and unpredictability of leaking backup unit failure. (4)DESCRIBE WHY YOU BELIEVE THE ORDER REPRESENTS THE BEST VALUE CONSISTENT WITH FAR 8.4 TO AID THE CONTRACTING OFFICER IN MAKING THIS BEST VALUE DETERMINATION: Aff-Mcquay has a GSA contract, GS-21F-0027V, expiration 11/16/2014. FSS has dermined the price to be fair and reasonable. (6) DESCRIBE THE MARKET RESEARCH CONDUCTED AMONG SCHEDULE HOLDERS AND THE RESULTS OR A STATEMENT OF THE REASON MARKET RESEARCH WAS NOT CONDUCTED: The chillers not functioning have a 120 ton combined capacity. Aff-Mcquay has a 100 ton unit which will meet the minimum requirements until the VA units are repaired. Two other suppliers were contacted; who could not meet the required tons. Location, size of units, and urgency limited market research (7) ANY OTHER FACTS SUPPORTING THE JUSTIFICATION: Weather for this week has been extremely hot and humid putting stress on leaking unit. Unit needs repair quickly before it malfunctions and there is no cool air in a direct patient care areas. (8) A STATEMENT OF THE ACTIONS, IF ANY, THE AGENCY MAY TAKE TO REMOVE OR OVERCOME ANY BARRIERS THAT LED TO THE RESTRICTED CONSIDERATION BEFORE ANY SUBSEQUENT ACQUISITION FOR THE SUPPLIES OR SERVICES IS MADE: Two other quotes were obtained. Location, urgency and size of unit needed were limiting factors for competition. (9) REQUIREMENTS CERTIFICATION: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge. I understand that processing of this limited sources justification restricts consideration of Federal Supply Schedule contractors to fewer than the number required by FAR Subpart 8.4.
