Description
This announcement serves as public notification that the National Park Service, Olympic National Park awarded a non-competitive contract (sole source) for emergency replacement and installation of two well pumps that failed after lightnigh storm event within Olympic National Park. This notice is issued in accordance with Federal Acquisition Regulation 6.305(a) and (b), and is NOT a request for competitive quotes. JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION for SIMPLIFIED ACQUISITIONS OVER $3,000 AND UP TO $100,000 (See FAR 13.106-1) Date: July 15, 2012 / Requisition Number: R9512120161 1. Nature and/or description of the item/service being procured and its intended use (include the anticipated cost): Non-competitive award to Aqua Pumps and Well Drilling, Inc. (DUNS: 142698880) for emergency on-site inspection of damaged well pumps to determine parts/equipment necessary for complete replacement with new well pumps. Contract price schedule included Contractor's hourly rate of $200/hour for an estimated 30 hours, plus the price for the pumps (two pumps at $4,500 each), plus parts ($1,200 for pipe reducers and check valves), plus express shipping of the pumps at $600. Total order price was awarded as a not-to-exceed amount of $16,800. The price of $200/hour was determined to be fair and reasonable, based a past project competed between two local small business vendors where Aqua Pumps and Well Drilling, Inc. was the lowest price in that acquisition, selected for award, and performed successfully. 2. Sole Source Justification rationale (Check one and explain below): ______Only one responsible source. __ X__Urgent and compelling circumstances exist. Include critical delivery or performance dates, and when you became aware of the requirement. Provide a specific statement of the impact on Government operations, financial or otherwise, if the required delivery or performance dates are not met. ______ Other _____________________________________________________ Explain: A non-competitive purchase order was awarded in accordance with the authority at Federal Acquisition Regulation (FAR) 6.302-2, Unusual and Compelling Urgency (U.S.C.3204(c)(2)). A lightning storm event occurred over the weekend of July 14-15, which is suspected to have caused damage to the pumps and they stopped working entirely. The pumps provide potable water (drinking water) to the Lake Crescent/Barnes Point area, which includes the Concession run Lake Crescent Lodge, and nearby NatureBridge which hosts public events/meetings, and student programs. Both the Lodge and NatureBridge had overnight guests at the time the pumps went down, and nobody had drinking water in the area. The Concessionaire was providing bottled water to their Lodge guests until the park could replace the pumps. Olympic National Park utilities staff were able to provide water to the Concessionaire and NatureBridge from a fire emergency system, whereby guests were able to take showers and flush toilets, but that system was not tested or approved to be used for drinking water. Restoring potable water (drinking water) to the area was urgent and compelling, because not having potable water was considered a public health and safety risk. 3. Market Research. Please explain the results or why one was not performed. State whether any other offers were received or anyone expressed interest: The Utilities Supervisor had knowledge of three vendors in the local area. Aqua Pumps and Well Drilling, Inc. was selected based on Olympic National Park's Utilities Supervisor's knowledge of past experience working with this contractor, knowing the contractor has the level of experience required for doing the work, and successful past performance. The contractor was called Sunday, July 15th and arrived on-site first thing Monday, July 16th, and started working right away inspecting the existing pumps and ordering new pumps for express delivery, and other necessary work. There was not sufficient time to compete the requirement between two or more local small businesses prior to the need for on-site work to begin. 4. If this is a determination for sole source, the Contracting Officer certifies: a. Only one source is available, or urgent and compelling circumstances exist. b. The anticipated price will be determined fair and reasonable using the price analysis techniques described in FAR Part 13.106-3(a).
