Description
The US Army Contracting Command - New Jersey, Soldier Weapons (ACC-NJ-SW) on behalf of the Office of the Project Manager, Soldier Weapons (PM-SW) anticipates soliciting and negotiating on a sole source basis with Leupold & Stevens, Inc. 1440 NW Greenbrier Parkway, Beaverton, OR 97006-5790 for the acquisition of the XM2010 Enhanced Sniper Rifle Sustainment Day Optics, P/N 115604, NSN 1240-01-603-2241 nomenclature 6.5-20x50mm Mark 4 ER/T, Locking Adjustment M5A2, H-58, MK248 Mod 1 Optic. In accordance with 10 U.S.C. 2304(c)(1) as implemented by FAR 6.302-1(a)(2)(ii)(A) supplies may be deemed to be available only from the original source in the case of a follow-on contract for the continued development or production of a major weapon system or highly specialized equipment when it is likely that award to any other source would result in substantial duplication of cost to the Government that will not be recovered through competition, in particular, for the continuation of highly-specialized supplies. FAR 6.302-1(a)(2)(ii)(A) is deemed applicable because an award for any other optic would have to undergo the same testing, system development and demonstration, and life cycle sustainment planning activities that were required for the Leupold and Stevens' optic to ensure that the optic is both operationally sufficient and can support the Soldier. However, performing these activities would result in substantial duplication of costs. Additionally, an analysis of alternatives to other than full and open competition for the XM2010 Enhanced Sniper Rifle Sustainment Day Optics was conducted. The alternative identified was full and open competition utilizing a technical data package. However, the combination of high risks in the areas of cost, schedule, and performance are unacceptable to the Government and support the acquisition of the XM2010 Enhanced Sniper Rifle Sustainment Day Optics on a sole source basis. Award of a sole source contract to Leupold & Stevens would be in the best interest of the Government. The anticipated contract requirement will be a five year, Firm Fixed Price, Indefinite Delivery Indefinite Quantity contract. The minimum number of XM2010 Enhanced Sniper Rifle Sustainment Day Optics is 72 units. The maximum number of XM2010 Enhanced Sniper Rifle Sustainment Day Optics is 1242 units. The anticipated award date for this action is September/October 2012 timeframe. Please note that this notice does not constitute a Request For Proposal (RFP). All responsible sources may submit a capability statement, proposal, or quotation, which will be considered by the Government. A determination by the Government not to compete this proposed contract action based upon the response to this notice is solely within the discretion of the Government. This notice is not a solicitation and does not obligate the Government to issue a solicitation, nor will the Government be liable for any costs involved for submission of information in response to this notice.
