Description
CD492 The Department of Commerce, NOAA, National Weather Service (NWS), Engineering and Acquisition Branch intends to negotiate on sole source basis, under authority of Federal Acquisition Regulation (FAR) Subpart 6.302 Other Than Full and Open Competition, with Proton Energy Systems, Inc., using the procedures in FAR Parts 6 and 13. The award will be a firm fixed price purchase order. The NWS Maintenance Branch requires S Series 10 Cell Stacks (P/N: CKTSS11000000) that will be used in S Series Hydrogen Generators owned by the NWS, and in the Cooperative Hurricane Upper Air Station Network in the Caribbean. Proton Energy Systems, Inc., is the only party known to the NWS who can meet this requirement; is the manufacturer of the S Series Hydrogen Generator and sole provider of its replacement parts. The statutory authority for other than full and open competition is 41 USC 253(c)(1) as implemented by FAR 6.302-1, only one responsible source. The North American Industry Classification Code (NAICS) for this acquisition is 334515 with a Small Business Size Standard of 500 employees. This is not a solicitation for competitive quotes, however Vendors who believe they can satisfy the Government's requirements are invited to submit an affirmative response. To be considered an affirmative response, vendors must submit written data and documentation that reflect meeting the aforementioned requirement. All responsible sources must submit a written narrative statement of capability including detailed technical information and other technical literature sufficient to permit agency analysis to determine a bona fide capability. Any information received will be considered solely for the purpose of determining whether to conduct a competitive procurement. Affirmative responses must be received within 15 days after publication of this synopsis. Information related to the potential availability of other sources that can fulfill this requirement must be received by the POC listed below no later than 12PM eastern time on Thursday, August 2, 2012, POC: Jeffrey Paul, NOAA/National Weather Service, 1325 East-West Highway, Room 3176, Silver Spring, MD 20910.
