- COMPLETE THE SF 1449 WITH YOUR PROPOSAL COMBINED SYNOPSIS/SOLICITATION Integrated Ecosystem Assessment (I) This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice and in accordance with the simplified acquisition procedures authorized in FAR Part 13. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. (II) This solicitation is issued as a request for quotation (RFQ). Submit written quotes on RFQ Number NCND6000-12-02621DT. (III) The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-59. (IV) This procurement is unrestricted and opened to all sources. The associated NAICS code is 541990. The business size standard is $14.0 million. (V) This combined solicitation/synopsis is for purchase of the following commercial services: CLIN 0001 Provide non-personal services to conduct the following in support of the California Current Integrated Ecosystem Assessment (CC-IEA), and nested Monterey Bay National Marine Sanctuary Integrated Ecosystem Assessment (NBNMS-IEA): (1) Facilitation and Coordination Services, (2) Scientific Analysis, Data Synthesis and Review Services, and (3) Public Scoping and Communications Services as described in the statement of work. (VI) Description of requirements is as follows: Statement of Work Monterey Bay National Marine Sanctuary California Current Integrated Ecosystem Assessment SUMMARY NOAA's Monterey Bay National Marine Sanctuary (MBNMS) requires technical and scientific support for the California Current Integrated Ecosystem Assessment (CC-IEA) and the nested Monterey Bay National Marine Sanctuary Integrated Ecosystem Assessment (MBNMS-IEA). MBNMS is serving as a pilot management location for several components of the CC-IEA, and will need services focused on three broad categories: (1) Facilitation and Coordination Services, (2) Scientific Analysis, Data Synthesis and Review Services, and, (3) Communications/Outreach Services. BACKGROUND MBNMS is serving as a tangible study area for: 1) developing communications products, 2) expanding the IEA model scope, products and outputs to improve their applicability for management, and 3) testing the effectiveness of current management strategies and evaluating potential management strategies by applying the analytical approaches from IEA models. Technical and scientific staff will contribute to the CC-IEA deliverables by serving on a number of different working groups (Communications Team, Scoping Team, Risk Assessment team) and action teams while reviewing interim products for local and regional management relevance as needed. SCOPE OF WORK The purpose of the contract is to conduct the following services in support of the CC-IEA and nested MBNMS-IEA: (1) Facilitation and Coordination Services, (2) Scientific Analysis, Data Synthesis and Review Services, and (3) Communications/Outreach Services. Task 1. Facilitation and Coordination Services This task includes continued facilitation, coordination and collaboration with the National Marine Fisheries Service (NMFS), National Centers for Coastal Ocean Science (NCCOS), Sea Grant, State Resources Agencies, non-governmental organizations (NGOs) and the staff of the West Coast Governors Agreement to support development of the CCIEA and MBNMS-IEA, with particular emphasis on generating outputs to service the needs of management and decision-making bodies. Contractor will work closely with other NOAA scientists and managers to ensure that the IEA is an effective applied tool for ecosystem-based management. This will be done by providing input on management priorities from the five west coast sanctuaries at CC- IEA meetings; identifying information needs and the availability of relevant regional datasets; and suggesting approaches for improving the utility of the IEA to address ongoing MBNMS policy and management decision-making. Deliverables a. Written and oral reviews as well as development of IEA processes and products (e.g., review model performance) to improve IEA b. Written and oral recommendations to ensure that products and outputs can be integrated into management and decision-making (e.g., identify management priorities, develop management scenarios, and identify information needs) c. Development of nested IEA focused on Monterey Bay as a pilot for regional IEAs d. Written and oral communications on with key IEA partners and stakeholders to communicate the purpose, goals and outputs of the IEA e. Written suggestions to IEA team for future direction of IEA f. Written realistic management scenarios to test in MBNMS-IEA and West Coast Sanctuaries g. On-line expert scientist risk assessment survey h. Oral and PowerPoint Presentations on MBNMS contributions, input and questions at IEA related meetings Task 2. Scientific Analysis, Data Synthesis and Review Services: Contractor will continue to review and provide feedback on different model approaches, evaluate outputs from a scientific and management perspective, and synthesize and compile data and information at the scale of MBNMS. This includes: i) identify key research questions, data needs and limitations, ii) compile and synthesize spatial and non-spatial data, iii) collect additional information for models, analysis and risk assessment through workshops, data analysis, and stakeholder meetings, and iv) suggest additional model needs, analysis and direction for understanding the policy implications of different approaches. Scientific work will be focused on two components of the CC-IEA, described in more detail below. • Risk Assessment: Provide feedback and input on the ecosystem risk assessment to demonstrate connections between specific human activities and valued ecosystem components in a way that enables managers and policymakers to prioritize problems. Specifically, Contractor will complete the DRAFT risk assessment plan for MBNMS to analyze the effects of different activities on ecosystem components, provide GIS analytical support, and help coordinate and facilitate testing of different approaches. This will be accomplished by hosting working groups with scientists and stakeholders for a MBNMS-scale pilot risk assessment as a model for regional risk assessments. In addition, MBNMS will be used as a pilot for comparing a data-driven risk assessment (based on quantitative and spatially explicit data on exposure of habitats and species to different pressures and a qualitative, literature-based scoring of sensitivity to those pressures) with a risk assessment based on expert scientific opinion. MBNMS's Research Advisory Panel will be used as the expert panel, and will facilitate this comparison study. Finally, MBNMS stakeholders will serve as a pilot for collecting information on potential risk and vulnerability to different stressors. • Management Strategy Evaluation: Contractor will generate management strategies with input from west coast sanctuaries for several purposes. Management strategies will be used for multiple communications products (e.g., webinars, videos) and will be applied to test the utility of the IEA model in determining the ecosystem-wide effects of different management scenarios. Deliverables a. Oral and written scientific review and input for the CC- and MBNMS-IEA b. Written list of major research and management questions for IEA c. Co-authored publications and reports (e.g., technical memos, peer-reviewed publication on risk assessment) from IEA outputs d. Data summaries, data analyses and data layers for the MBNMS-IEA e. Oral and written recommendations for decision making processes (e.g., NMFS Essential Fish Habitat Review f. Spatial data layers for the MBNMS risk assessment g. Written review of utility of available data sources (e.g. water quality) for the IEA h. Oral and written list of recommendations for future spatial and non-spatial data needs Task 3. Communications/Outreach Services Contractor will serve on committees and working groups (Video team, Webinar team, Message Box team, Wed Site team, Scoping team) for the CC-IEA to identify communications and outreach needs and develop communications products that are applicable at the scale of the California Current. MBNMS is being used as a pilot location to evaluate the effectiveness of different approaches for engaging stakeholders, local, state and federal agencies and NGOs in the CC-IEA by developing and distributing outreach products. This task includes: • Co-write and co-edit the NOAA Integrated Ecosystem Assessment Guidance Handbook • Assist in coordinating and developing CC-IEA video products • Contribute to development of messaging products for multiple outreach purposes • Contribute to the development of a series of IEA/CC-IEA webinars • Assist in creating an IEA/CC-IEA web site Deliverables a. Oral communications and written plans for objectives, audiences, participant roles, major themes, expectations, directions and extent of pilot scoping in collaboration with partners and stakeholders (requires travel) b. Co-authored publications, brochures, reports, presentations for outreach products c. Contribute to NOAA's On-line web site for CC-IEA d. A 3-5 minute video on the CC-IEA e. Communications (co-develop presentations, conferences, written reports, web sites) on IEA process and findings to agencies, stakeholders, NGOs and industry REQUIRED EXPERIENCE AND SKILLS 1. Masters degree or equivalent experience in the field of marine research and at least three years proven experience in resource management, research and policy issues related to marine and coastal protection. 2. Demonstrated knowledge of marine and ecosystem issues in the MBNMS and other west coast sanctuaries, including fishery-related issues, habitat and ecosystem protection. 3. Expertise in marine ecology, fisheries biology, spatial and data base analysis. 4. Demonstrated ability and experience in developing recommendations, plans and policies to address ecosystem protection, including fishery-related activities, habitat protection, MPAs and other coastal issues. 5. Knowledge of existing federal, state, and local programs, funding sources, public and private partners that could be used to implement resource management plans and experience in coordinating complex multiagency implementation of ecosystem protection plans. 6. Ability to evaluate proposed projects and plans to assess impacts to natural resources, and recommending corrective actions including evaluating and utilizing ecosystem monitoring data to inform resource management decisions. 7. Skill in communicating complex technical subjects for professional and lay audiences. 8. Knowledge and skill in conflict resolution, meeting facilitation, and collaborative planning among participants with diverse backgrounds and conflicting interests. 9. TRAVEL AND OTHER DIRECT COSTS Limited travel and other direct costs will be reimbursed not to exceed $8,000. PERIOD OF PERFORMANCE Period of performance is 12 months from date of award. IT SECURITY REQUIREMENTS The contractor is required to meet the DOC IT Security Program Policy (http://home.commerce.gov/CIO/ITSITnew/IT_Security_Program_Documentation.html). The government will provide the necessary computer equipment and information to perform this contract. All work must be performed upon government furnished equipment and if addition hardware and/or software is needed, the contractor must request the additional requirements from the Contracting Officer Representative (COR). The contractor must use government furnished equipment (GFE), which is currently covered by an existing government Certification and Accreditation (C&A) package. The C&A requirements of Clause 73 do not apply, and therefore a Security Accreditation Package is not required. The contractor must consider IT Security controls throughout the lifecycle of this contract as outlined in NIST Special Publication 800-64 (http://csrc.nist.gov/publications/nistpubs/800-64/NIST-SP800-64.pdf). The contractor shall guarantee strict confidentiality of the information/data that it is provided by the Government during the performance of the task order. The Government has determined that the information/data that the contractor will be provided during the performance of the task order is of a sensitive nature. Disclosure of the information/data, in whole or in part, by the contractor can only be made after the contractor receives prior written approval from the Contracting Officer. Whenever the contractor is uncertain with regard to the proper handling of information/data under the contract, the contractor shall obtain a written determination from the Contracting Officer. Knowledge Transfer The contractor shall provide, as necessary, periodic training whenever the contractor introduces new processes, new technology or when the contractor changes existing processes or technology. All processes and technology changes must be thoroughly documented. It is the responsibility of the contractor to mentor government identified personnel regarding the new or changed process or technologies. When there is a transition within the contractor's staffing, the contractor shall be responsible for ensuring the incoming personnel is fully versed on any outstanding project deadlines, roles and responsibilities before the new person arrives on the job. In the case of when the services of the contractor is no longer required, the contractor shall begin the knowledge transfer to government personnel or its designated representative at least three weeks before the final contract termination date. Restrictions Against Disclosure The contractor agrees, in the performance of this contract, to keep the information furnished by the Government and designated by the Contracting Officer or Contracting Officer's Technical Representative in the strictest confidence. The contractor also agree not to publish or otherwise divulge such information in whole or part, in any manner or form, nor to authorize or permit others to do so, taking such reasonable measures as are necessary to restrict access to such information while in the contractor's possession, to those employees needing such information to perform the work provided herein, i.e., on a "need to know" basis. The contractor agrees to immediately notify the Contracting Officer in writing in the event that the contractor determines or has reason to suspect a breach of this requirement. The contractor agrees that it will not disclose any information described in performance of this activity to any persons or individual unless prior written approval is obtained from the Contracting Officer. Whenever the contractor is uncertain with regard to the proper handling of information/data under the contract, the contractor shall obtain a written determination from the Contracting Officer. The Contractor agrees to insert the substance of this clause in any consultant agreement or subcontract hereunder. (VII) Place of delivery and acceptance is Monterey Bay National Marine Sanctuary, N/ORM6X22, 299 Foam Street, Suite D, Monterey, CA 93940. Delivery shall be FOB Destination. Period of performance shall be 12 months from date of award. (VIII) FAR 52.212-1, Instructions to Offerors -- Commercial Items (Feb 2012) applies to this acquisition. 1. Experience: Offerors must submit a statement of their experience and qualifications in regards to meeting the work requirements of this contract. 2. Technical Approach: Offerors must submit a proposal describing how they will fulfill the work requirements of this contract. 3. Past Performance: Offerors shall submit contact information of at least two references who can provide information pertaining to the offeror's performance of relevant work. Provide name, email address, phone number for the contact. The Government reserves the right to consider past performance information in addition to the references submitted by the offerors Inquiries (Apr 2010). The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government after evaluation of the following factors: Factor 1 - Experience: The Government will evaluate to determine the extent to which the offeror has completed work similar to work requirements of this contract. Factor 2 - Technical Approach: The Government will evaluate the extent to which the offeror's proposal demonstrates an ability to fulfill the work requirements of this contract. Factor 3 - Past Performance: The Government will evaluate the quality of offeror's performance of relevant work. The Government will assign a neutral rating to an offeror with no relevant past performance. If an offeror has no relevant past performance, it should include a statement to that effect in its proposal. A failure to submit past performance or affirmatively state that an offeror does not have any past performance may result in the offeror being considered non-compliant. The Government reserves the right to consider past performance information in addition to the references submitted by the offerors. (End of clause) 1352.209-73 COMPLIANCE WITH THE LAWS (APR 2010) The contractor shall comply with all applicable laws, rules and regulations which deal with or relate to performance in accord with the terms of the contract. (End of clause) 1352.209-74 ORGANIZATIONAL CONFLICT OF INTEREST (APR 2010) (a) Purpose. The purpose of this clause is to ensure that the contractor and its subcontractors: (1) Are not biased because of their financial, contractual, organizational, or other interests which relate to the work under this contract, and (2) Do not obtain any unfair competitive advantage over other parties by virtue of their performance of this contract. (b) Scope. The restrictions described herein shall apply to performance or participation by the contractor, its parents, affiliates, divisions and subsidiaries, and successors in interest (hereinafter collectively referred to as "contractor") in the activities covered by this clause as a prime contractor, subcontractor, co-sponsor, joint venturer, consultant, or in any similar capacity. For the purpose of this clause, affiliation occurs when a business concern is controlled by or has the power to control another or when a third party has the power to control both. (c) Warrant and Disclosure. The warrant and disclosure requirements of this paragraph apply with full force to both the contractor and all subcontractors. The contractor warrants that, to the best of the contractor's knowledge and belief, there are no relevant facts or circumstances which would give rise to an organizational conflict of interest, as defined in FAR Subpart 9.5, and that the contractor has disclosed all relevant information regarding any actual or potential conflict. The contractor agrees it shall make an immediate and full disclosure, in writing, to the Contracting Officer of any potential or actual organizational conflict of interest or the existence of any facts that may cause a reasonably prudent person to question the contractor's impartiality because of the appearance or existence of bias or an unfair competitive advantage. Such disclosure shall include a description of the actions the contractor has taken or proposes to take in order to avoid, neutralize, or mitigate any resulting conflict of interest. (d) Remedies. The Contracting Officer may terminate this contract for convenience, in whole or in part, if the Contracting Officer deems such termination necessary to avoid, neutralize or mitigate an actual or apparent organizational conflict of interest. If the contractor fails to disclose facts pertaining to the existence of a potential or actual organizational conflict of interest or misrepresents relevant information to the Contracting Officer, the Government may terminate the contract for default, suspend or debar the contractor from Government contracting, or pursue such other remedies as may be permitted by law or this contract. (e) Subcontracts. The contractor shall include a clause substantially similar to this clause, including paragraphs (f) and (g), in any subcontract or consultant agreement at any tier expected to exceed the simplified acquisition threshold. The terms "contract," "contractor," and "Contracting Officer" shall be appropriately modified to preserve the Government's rights. (f) Prime Contractor Responsibilities. The contractor shall obtain from its subcontractors or consultants the disclosure required in FAR Part 9.507-1, and shall determine in writing whether the interests disclosed present an actual, or significant potential for, an organizational conflict of interest. The contractor shall identify and avoid, neutralize, or mitigate any subcontractor organizational conflict prior to award of the contract to the satisfaction of the Contracting Officer. If the subcontractor's organizational conflict cannot be avoided, neutralized, or mitigated, the contractor must obtain the written approval of the Contracting Officer prior to entering into the subcontract. If the contractor becomes aware of a subcontractor's potential or actual organizational conflict of interest after contract award, the contractor agrees that the Contractor may be required to eliminate the subcontractor from its team, at the contractor's own risk. (g) Waiver. The parties recognize that this clause has potential effects which will survive the performance of this contract and that it is impossible to foresee each circumstance to which it might be applied in the future. Accordingly, the contractor may at any time seek a waiver from the Head of the Contracting Activity by submitting such waiver request to the Contracting Officer, including a full written description of the requested waiver and the reasons in support thereof. (End of clause) Representation by Corporations Regarding an Unpaid Delinquent Tax Liability or a Felony Conviction Under Any Federal Law (Class Deviation) (March 2012) (1) In accordance with Sections 543 and 544 of Public Law 112-55 Commerce, Justice, Science, and Related Agencies Appropriations Act 2012, Title V (General Provisions) none of the funds made available by that Act may be used to enter into a contract with any corporation that- (a) Was convicted of a felony criminal violation under any Federal law within the preceding 24 months, unless the agency has considered suspension or debarment of the corporation and made a determination that this further action is not necessary to protect the interests of the Government. (b) Has any unpaid Federal tax liability that has been assessed, for which all judicial and administrative remedies have been exhausted or have lapsed, and that is not being paid in a timely manner pursuant to an agreement with the authority responsible for collecting the tax liability, unless the agency has considered suspension or debarment of the corporation and made a determination that this further action is not necessary to protect the interests of the Government.
