Description
Modification No. 1 The Prospectus is modified as follows: The NPS makes one correction and three additions to Appendix B: Excel Forms for Proposal Package. The correction is to the "Cash Flow Statement Form" where the NPS corrects the formulas in cells C38-K38 where the cells do not sum all the rows for investment activities. Each cell for row 38 from column B-K should sum rows 29-37. For example, the formula in cell C38 is "=SUM(C29:C31)". For cell C38, the correct formula is "=SUM(C29:C37)". The first addition is also to the "Cash Flow Statement Form" where the NPS adds the word "Provided" to the title of row 26 (Net Cash Used in Financing Activities), making the revised title "Net Cash Provided/Used in Financing Activities". The second addition is also to the "Cash Flow Statement Form" where the NPS adds a column for "Year Zero"(to the left of the column for year 2013) and, within that column, adds formulas for totals for row 18 (Net Cash Provided by Operating Activities), row 26 (Net Cash Used in Financing Activities),.row 38 (Net cash used in investing activities) and row 40 (Total Cash Flow). The third addition is to the "Income Statement Form" where the NPS adds a row for "Total Deductions", located below "Total Gross Revenue" and above "Total Gross Receipts (If different)." There is no formula for the corresponding rows and all subsequent formulas auto-adjust in MS Excel. The fourth addition is also to the "Income Statement Form" to add a formula for the new row 21, "Total Gross Receipts (If different)". The new formula is the difference between "Total Gross Revenue" and "Total Deductions". For example, the NPS adds the formula "=B19-B20" for cell B21. The NPS recommends all Offerors either make the additions and correction as described above, or download the corrected Appendix B. The corrected Appendix B is now available on the NPS Commercial Services website. The link is http://www.concessions.nps.gov/blri008-13.htm. There are some places in the PSF4 worksheets where the calculations formulas result in errors - should we fix them ourselves? See Modification No. 1. 2. Is there a specific list of Deferred Maintenance? The list of Deferred Maintenance is provided in the prospectus announcement posted at http://www.nps.gov/commercialservices/blri011-13.htm. Please refer to Exhibit H, Maintenance Plan Attachment under the Additional Files Banner. 3. Peaks of Otter Lodge is currently open year round, but the Operating Plan specifies that the Lodge must be open between April 1 and November 30. Not year round? The Lodge has historically been open year round; however, since visitor demand during the off season months (December through March) is slow, the Service will not require the Concessioner to operate during the off season months. Therefore, minimum operating dates required by the Operating Plan correspond with the busy season of April 1 through November 30. The next concessioner may remain open year round, if it chooses. The Service maintains road access and utilities at Peaks of Otter year round. 4. Is there an exemption for "craft sales" when calculating franchise fee amounts? Franchise Fees are paid based on a percentage of Gross Receipts. The Draft Contract defines the exemptions to Gross Receipts. Section 416(b) of the National Parks Omnibus Management Act of 1998 exempts the revenues derived by NPS concessioners from the sale of United States Indian, Alaska Native, Native Samoan, and Native Hawaiian handicrafts from concession contract franchise fees to encourage Native American handicraft sales by concessioners. Concessioners must mark sales items that are authentic native handicrafts with a label attesting to the item's authenticity, and maintain sales receipts for those items in order to be eligible for franchise fee exemption.
