Description
The United States Department of Labor, on behalf of Employment Benefits Security Administration, Office of Technology and Information Services (EBSA/OTIS), has a requirement for Concordance FYI Server software and Concordance FYI Reviewer software. EBSA/OTIS supports both civil and criminal investigations through its field offices. All EBSA field offices are currently using Concordance Litigation Support software to review and analyze electronic evidence. EBSA has several Inter-Governmental partnerships. Electronic evidence is exchanged and shared between these partnerships (to include law firms) in a proprietary Concordance format. The Concordance provides a unique database format that makes it easy to identify, organize, and analyze case-critical information. It provides EBSA investigators, Benefits Advisors and other users with a tool that allows them to search, collaborate, and share information across geographical boundaries. Concordance software is proprietary to LexisNexis, who is the manufacturer and sole source of the software. EBSA/OTIS supports both civil and criminal investigations through its field offices. The types of investigations which use this software are the largest, highest profile investigations which have the largest impact on the protection of pension and welfare benefit participants. The majority of EBSA field offices utilize Concordance Litigation Support software to review and analyze electronic evidence. One of EBSA's Inter-Governmental partnerships is with the Securities and Exchange Commission (SEC). Concordance is the SEC standard litigation support application. Throughout its investigations, the SEC, EBSA, and other Federal agencies exchange data in a Concordance-readable format. Concordance is also used by law firms which represent the entities that are the subject of EBSA investigations. The SEC, DOJ and other agencies often refer cases to EBSA when they discover pension fund irregularities during their investigations. The Department intends to enter into a sole source award with Reed Elsevier, Inc. (DBA LexisNexis), 9393 Springboro Pike, Miamisburg, OH, 45342-4425. This proposed award will be made under Simplified Acquisition Procedures and is being conducted under the authority of 10 U.S.C. 2304 (c) (1) - FAR 6.302-1, which allows for other than full and open competition when "supplies or services required by the agency are available from only one responsible source and no other types of supplies or services will satisfy agency requirements..." This action will result in a Firmed-Fixed Price contract with a Base of one year and 2 one-year option periods. The anticipated award date is July 09, 2012. This notice of intent to award a sole source contract is neither a request for competitive proposals nor a solicitation of offers. There is no solicitation document. A determination by the Government not to compete this proposed contract based on responses to this notice is solely within the discretion of the Government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement. The NAICS code for this requirement is 518210, Data Processing, Hosting and Related Services, with a size standard of $25.0 million. No telephone calls will be accepted.
