- S pecial Notice: Justification for Exception to Fair Opportunity DESCRIPTION OF THIS ACTION: This is not a solicitation for offers. GSA, Assisted Services Acquisition, Region 7, intends to issue a fair opportunity solicitation to award Multiple Award Master Task Order(s) under the GSA Connections II Contact in support of the FBI structured cable plant requirements for Data/Voice Infrastructure (Cabling) and Telecommunication Systems Installation. This special notice is to advise that this requirement utilizes brand name specifications that will apply to a portion of the overall requirement, and the requirement will specify certain Tyco/AMP, Great Lakes, Dell, Hewlett Packard, Chatsworth, Avaya, and miscellaneous related products in the project requirements. It is anticipated that several Connections II contractors are capable of fulfilling this requirement. DESCRIPTION OF SUPPLIES AND SERVICES: Below are major items/groupings that are contained in the IDIQ which are brand specific for FBI cabling and telecommunications requirements: Great Lakes, Dell, Hewlett Packard Chatsworth EMCOR Racks Tyco AMP Secure Products MR Tech Fiber Zone Enclosures and Accessories (Fiber Pigtails) General Dynamics KG 175 Shelf EZ Path Series Firestop Cover, Single Gang 1" opening Split Plate Wiremold Cable Management Items Maxcell Inner duct Hoffman Enclosure and Lock Kit Sergeant and Greenleaf Exposed Lock Glyptol Sealant Surge Technologies/Circa Enterprises/LEA Networks- 25 Pair Entrance Surge Protectors Circa Enterprises/Porta Systems- 12 Pair Entrance Surge Protectors Lucent Technologies/Circa Enterprises/Porta Systems- 6 Pair Entrance Surge Protector Times Microwave Plenum Satellite Cable General Wire Products- Security Cable Avaya Solid State 5 Pin surge Suppression Module Avaya VoIP Key and PBX Systems STATUTORY AUTHORITY: Federal Acquisition Regulation 16.505(b)(2)(i)(B), 16.505(a)(4) and 6.302-1(c), application of brand name items. APPLICABILITY OF AUTHORITY: The requested brand name specifications (already integrated into the FBI 's installation design plan) have been tested to meet FBI information security assurance requirements and ensure compatibility with existing telecommunications hardware infrastructure. Procurement of the specified brand names also aids the agency to reduce costs associated with training employees to maintain networks using a variety of different types of network hardware. Acquiring the following products are essential to the FBI Technical Services Support Unit requirements and redesign of the network installation plan to omit the brand name specifications requires extensive time and testing that are not afforded under the current facility construction schedules. Additionally, market research indicates other companies' similar products, or those products that lack a necessary feature, do not meet or cannot be modified to meet FBI's secure network infrastructure needs. These product lines have been certified as compatible with FBI telecommunications testing requirements and no substitute of brand or model is suitable. Avaya specified technical equipment and parts is the only source that will satisfy the agency's needs for the following equipment: Private Branch Exchange (PBX) Systems, Key Telephone Systems and ancillary related equipment (voicemail system, automatic call distribution system, attendant console management system, station message detail recording system and battery reserve power system). These Avaya components are an integral part of the FBI's telecommunications services and have had a presence in all of the FBI's offices. Based on technical assessment results from separate divisions, it has been determined that Avaya, Inc. is the only acceptable brand/source to meet these needs. EFFORTS TO OBTAIN COMPETITION AND DETERMINATION THAT THE ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND REASONABLE: This requirement will be solicited using fair opportunity under GSA's Connections II contract. Brand name specifications only apply to a portion of this requirement. The specified brands and Avaya system equipment are widely available and several Connections II contractors can supply these requirement. GSA expects that the resulting competition will result in fair and reasonable price proposals. CONTRACTING OFFICER'S CERTIFICATION: The Contracting Officer's signature on the approved Justification for Other than Full and Open document evidences that they have determined this document to be both accurate and complete to the best of their knowledge. CONTRACTING OFFICER'S DETERMINATION: The justification for other than full and open competition has been signed and approved and is based on authority in FAR Part 16.505(b)(2)(i)(B) and 6.302-1(c). Only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized. Based on the above documentation and the approved justification, this acquisition is restricted to Brand Name Only as specified.
