- On June 12, 2012, the Department of Energy entered into a barter contract with American Centrifuge Demonstration, LLC. In accordance with Federal Acquisition Regulation (FAR) 6.305, this notice provides the previously approved justification for other than full and open competition. JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION 1. Agency and Contracting Activity: The U.S. Department of Energy (DOE) intends to contract through other than full and open competition with American Centrifuge Demonstration, LLC (ACD). This document provides the justification and approval for the use of non-competitive procedures pursuant to 41 U.S.C. ? 3304(a)(1). 2. Nature and/or Description of the Action Being Approved: This is a sole-source acquisition of approximately forty centrifuges, model AC100, necessary facility items, and optional support services for the use in the research, development and demonstration (RD&D) of a U.S.-origin advanced uranium enrichment technology. Acquiring these centrifuges will assist in the United States' ability to have a domestically-owned enrichment capability to provide a source of fuel for the Nation's nuclear power reactors and to serve the national security needs of the United States. 3. Goods to be Acquired: The action is to acquire forty or more centrifuges and necessary facility items in exchange for assuming specified liability and providing rent-free use and right of return of the equipment. 4. Identification of the Statutory Authority Permitting Other Than Full and Open Competition: The applicable authority is 41 U.S.C. ? 3304(a)(1): "the property or services needed by the executive agency are available from only one responsible source and no other type of property or services will satisfy the needs of the executive agency." 5. Demonstration of Unique Contractor Qualifications: ACD is uniquely qualified to provide these centrifuges in meeting the critical national security requirement that enrichment technology be of U.S.-origin. No other entity can produce the centrifuges and associated facility items necessary to continue the ongoing centrifuge RD&D program. No other entity has the experience necessary to provide the option items. 6. Efforts to Solicit Offers From As Many Sources As Practicable: ACD is the only source that can currently provide the services, thus no other sources were solicited. As noted below in item 8, no entities expressed interest in response to a Notice of Intent. 7. Determination of Fair and Reasonably Anticipated Cost: The anticipated value of the proposed acquisition is approximately $10,000,000. A price analysis will be performed by the Contracting Officer to ensure a fair and reasonable price. 8. Description of Market Research Conducted: No market research was conducted as ACD is the only entity that can provide these centrifuges based on its work on the ACP. On May 22, 2012, a Notice of Intent was published on the Federal Business Opportunities (FedBizOpps) website to provide information regarding DOE's intention to award a sole source contract to ACD. The notice provided interested parties the opportunity to submit questions and capability statements to DOE. No interest in this notice was received. 9. Other Facts Supporting the Use of Other Than Full and Open Competition: See items 3 and 5. 10. List of Interested Sources: None. 11. Actions to Remove or Overcome Barriers to Competition: There are no barriers to competition that the DOE may remove. The equipment is unique and availability is a function of the market.
