DEPARTMENT OF VETERANS AFFAIRS Justification and Approval For Other Than Full and Open Competition 1.Contracting Activity Program Contracting Activity East - St. Louis VA Medical Center, Bldg. 2 #1 Jefferson Barracks, Drive St. Louis, MO 63125 2.Nature and/or Description of the Action Being Processed: EES plans to contract by means other than full and open competition for a Firm Fixed-Price contract. The proposed awardee is Creative Training Techniques International. 3.Description of Supplies/Services Required to Meet the Agency's Needs: EES requires sending five employees to the educational training event hosted by Creative Training Techniques International. Creative Training Techniques International will conduct it's branded conference training session for all of its registered participants on September 12th-14th, 2012 in Minneapolis, Minnesota. EES will be sending 5 employees to the conference that work at the Minneapolis Employee Education Resource Center (EERC). The estimated cost of this proposed acquisition is $4,975. 4.Statutory Authority Permitting Other than Full and Open Competition: ( X ) (5) Authorized or Required by Statute FAR 6.302-5; 5.Demonstration that the Contractor's Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): d. Authorized or Required by Statute (FAR 6.302-5) As a recognized expert in their field of expertise, Creative Training Techniques International has scheduled a training conference to be held in Minneapolis, Minnesota on Sept 12th -14th. They are the only vendor that offers the Creative Training International copy written training content. The content of this program meets the needs of EES and its EES employees that work at the Minneapolis, Minnesota EERC. The unique program content includes: Audience Response System Training (ARST), Converting to Web Based Training, Mentoring, Mobile Learning, Evidence based Learning, and Developing Case Studies. This material perfectly dovetails itself to both aligning the EES's desire of moving away from face to face conferences towards distance learning as well as it addresses employee performance gaps within the EERC employees. Also, according to Title 5 of the U.S. Code, Chapter 41 of Government Employee Training Act (GETA), allows the government to take advantage of all avenues, even those outside of government to train its employees. No competition is required. Paragraph 3 of Section 2 of the Act clearly states the intent. It states that "it is intended to improve public service, provide a more efficient workforce in the areas of expense and employee turnover and retain a well-educated workforce that is aware of developments in and out of government. From an administrative side, the intent is to provide uniform training and to ensure that all federal employees are treated equally in regard to job improvement". 6.Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable Creative Training Techniques International is the copyright owner of this program/content and as such is the only vendor that is offering this work shop for end users. Due to the dollar amount this acquisition will not be synopsized in FedBizOpps as required in FAR 5.201. 7.Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: This price for the conference has been discounted for government employees due to multiple attendees. This price is only available to government employees. 8.Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: The market research conducted searching GSA and Google and this is the only vendor offering locally the required training package (including: Audience Response System Training, Converting to Web Based Training, Mentoring, Mobile Learning, Evidence based Learning, and Developing Case Studies). 9.Any Other Facts Supporting the Use of Other than Full and Open Competition: This training is within local commuting distance for our employees so no travel funding will be expended. Local training opportunities targeted for our education professionals, such as this, are extremely rare.
