DEPARTMENT OF VETERANS AFFAIRS Justification and Approval For Other Than Full and Open Competition 05/30/2012 1.Contracting Activity: Program Contracting Activity East - St. Louis VA Medical Center, Bldg. 2 #1 Jefferson Barracks, Drive St. Louis, MO 63125 2.Nature and/or Description of the Action Being Processed: EES Plans to contract under other than full and open competition for a Firm Fixed-Price contract. The proposed awardee is SpeechPathology.Com. 3.Description of Supplies/Services Required to Meet the Agency's Needs: This purchase is for the VA Speech Therapist to take online training with Continuing Education Credit (CEU) which is required to meet professional standards required to maintain the VA's certifications. SpeechPathology.com will provide access to 500 commercial off the shelf (COTS) training courses and conferences. Each course is included in the $99.00 per membership for the VAs 192 Speech Therapist. The estimated cost of this proposed acquisition is $19.008.00 per year for a total life cycle cost of $38,016.00. This is a base plus 1 option year contract. 4.Statutory Authority Permitting Other than Full and Open Competition: ( X) ((5) Authorized or Required by Statute FAR 6.302-5 5.Demonstration that the Contractor's Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): b. Authorized or Required by Statute (FAR 6.302-5) - Government Employee Training Act (GETA) applies. This vendor's training supports VHAs national staff development requirements for Speech Therapist. It is required that 40 hours of continuing education training be done by the VA's Speech Therapist each year. Without this training the VA will not retain our required certifications. 6.Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: Researched was done via VetBiz, GSA and Google. Research has shown that there are no vendors that can provide the level of training required by VA. 7.Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: The Price offered to the VA is the same price that is only offered to all the company's clients and is in line with training of a similar nature done by the VA in the past. 8.Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: Researched was done via VetBiz, GSA and Google. Care2Learn; http://www.care2learn.com/ Offers a limited number of courses at individual cost that range from $21.95-$175.60. SpeechPathology.com www.speechpathology.com Price for unlimited course membership is $99.00 per year. Speech Pathology offers weekly seminars and online training to members. American Speech-Language-hearing Association http://www.asha.org Offers a limited number of courses at individual cost that range from $20.00-$111.00 Based on market research one vendor meets the needs of the government, for online training, and that is SpeechPathology.com. They offer a membership with unlimited access to their 500 CEU courses and are a small business concern. No Veteran owned small business could be located that provided the required training. 9.Any Other Facts Supporting the Use of Other than Full and Open Competition: While it is possible that another vendor could produce the training required it would take a considerable time and effort on the part of a vendor and would be cost prohibitive for the government to pay to have the training reestablished by another vendor when it is available via COTS. 10.Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: None 11.A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: Market research will be conducted prior to exercising any options to ensure no other vendor has entered the market place or has developed the required training needed by the VA. 12.Requirements Certification: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief. _____________________________ 05/31/2012 Ann Strong Date Project Manager EES ST LOUIS 13.Approvals in accordance with FAR 6.304 This part if filled out by Contracting Staff as part of the Justification a.Contracting Officer's Certification: (required) I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief. _____________________________ _______________________ Date Contracting Officer SAOE/ PCAE
