- NNC10CA10C - JOFOC JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION (JOFOC) This document is a justification for other than full and open competition prepared by the NASA Glenn Research Center. 1.The nature and/or description of the action being approved: This justification provides the rationale for contracting by other than full and open competition for the acquisition of the assembly of the multi-injector sector rig. The components of the rig were designed and built by General Electric as a result of a full and open NRA competition. The contract was a cost share contract that had cost over runs and the contract could not be completed under the original budget. 2.Description of the supplies or services required, include an estimated value: This contract will complete the assembly and testing of the multi-injector sector rig and provide a written report compiling the data from the test. The cost will be $495,500.00. 3.Statutory authority permitting other than full and open competition: 6.302-1 Only one responsible source and no other supplies or services will satisfy agency requirements. Authority - Citations: 10 U.S.C. 2304(c)(1) or 41 U.S.C. 253(c)(1). (ii) Supplies may be deemed to be available only from the original source in the case of a follow-on contract for the continued development or production of a major system or highly specialized equipment, including major components thereof, when it is likely that award to any other source would result in (A) Substantial duplication of cost to the Government that is not expected to be recovered through competition; or (B) Unacceptable delays in fulfilling the agencys requirements. (See 10 U.S.C. 2304(d)(1)(B) or 41 U.S.C. 253 (d)(1)(B).) 4.A demonstration that the proposed contractors unique qualifications or the nature of the acquisition requires use of the authority cited: Citations: 10 U.S.C. 2304(c)(1) or 41 U.S.C. 253(c)(1). 5.Description of the efforts made to ensure that offers are solicited from as many potential sources as practicable: The original contract was a result of a full and open competition, this is a continuation of the work started and unable to be completed within the original budget and schedule. 6.Description of the market survey conducted, and the results, or a statement of the reasons a market survey was not conducted: A market survey was not conducted because this PR is for one-of-a-kind work specific to this contract. Other companies would not have the capability to complete this work. This work to be done under this PR is as follows: (1) assembly and instrumentation of one-of-a-kind combustor sector hardware designed specifically for this contract, (2) support for testing and installation of this combustor sector hardware at a NASA facility, (3) recommendations on how to refine the combustor sector concept and address any shortfalls, and (4) final report preparation. Items #1 and #2 could not be done by another company because GE researched and designed the combustor sector hardware specifically for this contract. No other company would have the expertise to assemble, instrument, and install this hardware, and some of the hardware is GE-proprietary. In addition, GE is the only company that could provide item #3 and the test support specified in item #2 because GE is the only company with experience in testing this particular type (TAPS) of combustor sector. GE is also the only company that could provide item #4, final report preparation, because GE did the work that will be summarized in the final report. 7.Other facts supporting the use of other than full and open competition: Such as: b.When 6.302-1 is cited for follow-on acquisition as described in 6.302-1(a)(2)(ii), show an estimate of the cost that would be duplicated and how the estimate was derived. The estimate for the cost that would be duplicated is at least $6,500,000. This figure includes all the research that went into an engine systems study and combustor sector design as well as hardware fabrication. Another company could not use this research: GE brought considerable intellectual property to this contract and also provided a cost-share, so some of the research and hardware design is GE-proprietary. Even if this intellectual property issue could be ignored and another company could use the results of the research that led to GEs final design, the cost to design and fabricate combustor sector hardware would be more than $2,800,000. (The technical analysis of cost for the original contract listed $3,126,000 for combustor sector design, fabrication, assembly, and instrumentation. The portion of this PR that will be used for combustor assembly and instrumentation is less than $300,000.) 8.Sources, if any, that expressed an interest in writing in the acquisition: None 9.The actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required: The original contract was the result of an openly competed NRA. This NRA was for Phase I research, and two contractors were chosen. It is expected that a competitive down-select will occur for Phase II research. Notwithstanding NASAs expectation that only Phase I contractors will be capable of competing for Phase II, Phase II will be synopsized in the Commerce Business Daily and all proposals will be considered.
