Solicitation Number: SAQMMA12R0262 Notice Type: Presolicitation Synopsis: INFORMATIONAL NOTICE ONLY - NO RESPONSE IS SOLICITED AT THIS TIME The solicitation will be released in June, 2012 for award in July, 2012. The Department of State (DoS or Department) seeks to designate, through an unrestricted competitive source selection process, a qualified insurance company as its exclusive Defense Base Act insurance provider (Insurer) for a period of two years with an option to extend for six months. The Insurer shall sell the insurance to DoS contractors at the rates no higher than those set forth in an Agreement with the Department according to employee categories as follows: SERVICE EMPLOYEES (excluding Security Employees, Construction Employees, and Aviation Employees): Workers, either professional (e.g., registered professional engineers, licensed medical personnel, etc.) or non-professional, whose efforts are to accomplish discrete, often recurring, tasks that are not intended to result in an end-item of supply or a complete and useable facility. Such workers include, but are not limited to, information technology systems operators, consultants in any discipline, unarmed security personnel, architects, office administrators, researchers, cafeteria workers, nurses, maintenance personnel, drivers, housekeepers, flight-line personnel, medical technicians, grounds-keepers, hospital administrators, doctors and nurses, etc. CONSTRUCTION EMPLOYEES: Workers whose efforts are customarily associated with construction projects for complete and useable facilities or complete and useable alterations to existing facilities. Such workers include, but are not limited to, laborers, equipment operators, electricians, carpenters, painters, welders, concrete workers, steel workers, roofers, interior finishers, plumbers, glazers, etc. SECURITY EMPLOYEES: Workers who are armed and charged with the security of specific persons; property and/or facilities, including movement or transportation of persons and/or property between secure locations. AVIATION EMPLOYEES: Persons performing the onboard, ground-movement and in-flight operational duties associated with operating the aircraft under the direction and control of the pilot-in-command. Such workers include, but are not limited to, pilots and flight crew. The Department will consider offers from companies that qualify as follows: a. The offeror is rated as at least A- in A. M. Best's Insurance Report www.ambest.com (or an equivalent rating with a comparable insurance reporting company) for the prior five years. b. The offeror is on the United States Department of Labor list of insurance carriers approved to provide Defense Base Act insurance. www.dol.gov/esa BACKGROUND The "Defense Base Act" or "DBA" of 1941, Public Law 208 (42 U.S.C. 1651, et seq.) and the War Hazards Compensation Act ("WHCA") [42 U.S.C.S. § 1701 et seq.] provide workers' compensation benefits for the employees of U.S. Government contractors working overseas. DBA adopts most of the provisions of the Longshore and Harbor Workers' Compensation Act, 33 U.S.C. §§ 901-950, including insurance and benefit structures, claims procedures, and appeals process. Coverage is 24 hours a day and includes sickness, accident, injury and death. When a covered injury or death occurs to an employee, the contractor/employer notifies the Insurer who then makes a claim determination, and pays DBA compensation and medical benefits to the employee or his estate. When applicable, the Defense Base Act requires U.S. Government contractors to purchase workers' compensation insurance for their employees. If the recipients of Department of State grants or cooperative agreements award any contracts under their grants or cooperative agreements, the Defense Base Act requires those recipients' contractors and subcontractors at any tier to insure their employees. The federal government covers the costs of any injury or death that proximately results from a war-risk hazard as defined in the War Hazards Compensation Act by reimbursing the Insurer for the benefits it pays to the employee/beneficiary plus up to 15% for claims expenses. The effect of the War Hazards Compensation Act is to reduce significantly the risk to insurers of offering workers' compensation in a combat zone because it transfers the risk of injury during an attack to the federal government. The Insurer must coordinate with the Department of Labor to obtain reimbursement for any compensation it pays to an employee resulting from a war risk hazard. The term "eligible contractors" in the Agreement is defined as (1) any contractor and/or subcontractor at any tier required by law to obtain Defense Base Act insurance for its employees, and (2) any contractor and/or subcontractor at any tier required by law to obtain Defense Base Act insurance for its employees and which has been awarded a contract by a recipient of a Department of State grant or cooperative agreement. The recipients of Grants and Cooperative Agreements and their employees are not Government contractors and are not defined as eligible contractors under this Agreement. The Department will not require eligible contractors to purchase Defense Base Act insurance from the Insurer when: (1) they are self-insured in accordance with DoL regulations; (2) a waiver has been granted under FAR 28.305 (d) or Section 16 of the Department of State Basic Authorities Act (22 U.S.C. 2680a); or (3) they demonstrate to the Contracting Officer that they are able to obtain insurance from a DoL approved insurer at lower rates than those established in the Agreement.
