Description
This contract action was accomplished using other than competitive procedures because there is only one responsible source due to standardization requirements, and no other supplies or services will satisfy agency requirements. (FAR 6.302-1). See posted J&A for further information. JUSTIFICATION AND APPROVAL FOR OTHER THAN FULL AND OPEN COMPETITION 1.Contracting Agency: The responsible contracting agency is the U.S. Army Corps of Engineers, Savannah District, 100 West Oglethorpe Avenue, Savannah, Georgia 31401-3640. 2.Description of Action: This request is for approval of a sole source procurement for GE Proficy iFIX Portal Software for the Savannah Corps of Engineers Hydropower Project. Award of this contract to Advantage Industrial Automation, 4775 River Green, Parkway, Duluth, GA 30096 will provide software for existing Supervisory Control And Data Acquisition (SCADA) systems in order to help become DOD Information Assurance Certification and Accreditation Process (DIACAP) compliant. The estimated price is approximately $9,421.00. 3.Description of Supply: The contractor shall provide one (1) Proficy Portal Enterprise Edition 5 Client pack and associated software support. This software will replace current DICAP non-compliant Waterview software. The General Electric produced Proficy Portal Enterprise software will be used in combination with the current GE Proficy HISTORIAN application to provide remote viewing of SCADA system-generated reports. 4.Authority Cited: 10 U.S.C. 2304(d) (1) (B) and FAR 6.302-1(a) (2) (iii). Only one responsible source and no other supplies or services will satisfy agency requirements. 5.Reason for Authority Cited: Previous contract W912HN-06-P-00244 was issued to Advantage Industrial Automation Inc. for the original software package which included HISTORIAN and other SCADA software including subscriptions. The acquisition was purchased unrestricted under NAICS code 423430, FSC code 5895. Advantage Industrial Automation Inc is the sole GE authorized supplier and only source for Proficy software in the geographical region where the Hydropower Project is located. The software is not available from another source in a different geographical region or state. There is no other software which functions with the existing system and is DIACAP compliant. 6.Actions to Increase Competition: It is incumbent upon the Government to ensure project delays and additional costs do not occur. There is no other source equally qualified to provide the necessary requirements under the circumstances. The requirement of this supply cannot reasonably be met by another source because of the need to minimize cost and impact to project schedule. 7.Other Factors: Follow-on Contracts: This is a follow-on contract with additional requirements based on finding from the initial contract. In accordance with FAR 6.301-1(a)(2)(iii)(A), "For DOD, NASA, and the Coast Guard, services may be deemed to be available only from the original source in the case of follow-on contracts for the continued provision of highly specialized services when it is likely that award to any other source would result in (A) Substantial duplication of cost to the Government that is not expected to be recovered through competition or (B) Unacceptable delays in fulfilling the agency's requirements."
