- Description
- The purpose of this amendment is to provide a response to a question posted by a potential offeror. The following question is posted, along with the response. Q(6): In reference to FA8505-12-R-32095 pre-solicitation, does lack of required facility classification render the contractor ineligible to submit a proposal or will the contractor be given sufficient time to obtain required facility classification if awarded the contract? A(6): In accordance with FAR 9.104-1(f), To be determined responsible, a prospective contractor must - have the necessary production, construction, and technical equipment and facilities, or the ability to obtain them (see 9.104-3(a)). FAR 9.104-3(a) covers the ability to obtain resources and states that the contracting officer shall require acceptable evidence of the prospective contractor's ability to obtain required resources (see 9.104-1 (a), (e), and (f)). Acceptable evidence normally consists of a commitment or explicit arrangement, that will be in existence at the time of contract award, to rent, purchase, or otherwise acquire the needed facilities, equipment, other resources, or personnel. Sections L&M of the solicitation will give a timeframe when required facilities and resources need to be in place by the contractor. Prospective contractor proposals shall state the facilities and resources they have available to meet the solicitation requirements or provide evidence of how the prospective contractor will obtain the required facilities and resources within X number of days of contract award.
