- CLE DRAFT Statement of Work This is an advanced notification from the USAID Mission in Kosovo in anticipation of a Request for Proposals for a Contract Law Enforcement (CLE) Program. A draft Statement of Work is attached to provide you with more information on and to make comments, if any, on the upcoming CLE Program. The goal of the CLE Program is to implement activities which focus on improving the rule of law structures to lead to a better environment for economic growth and increased investment. The Program will aim to improve the overall contract and commercial law framework. It will do this by improving the quality of professionals focusing on contract and commercial law issues such as judges, lawyers and other legal professionals including jurists working for the business community. The Program will also aim at supporting the implementation of the anticipated new law on execution procedure, including the establishment and the functioning of a new bailiff system. Building mechanisms for and completing the reduction of the execution backlog will be an important part of the Program. Activities will be undertaken with the aim of improving the functioning of the arbitration tribunals and mediation mechanisms including the enforcement of arbitration awards and mediation agreements. Finally, the Program will work with the business community in order to establish a dialogue and make sure that all the above-mentioned reforms have been transformed into the business' community operations in daily practice. The two objectives of the CLE Program are to: 1.Improve systems for Enforcement of Judgments and Reduction of the Backlog in Enforcement Cases and 2.Develop the Contract and Commercial Law Framework and Systems, improvement of contract enforcement systems and the functioning of Alternative Dispute Resolution mechanisms. The attached Statement of Work is released for information purposes. Comments, if any, on the Statement of Work may be submitted as well. USAID Mission in Kosovo will consider all the comments submitted until Friday, May 25, 2012 COB Kosovo time and may revise the Statement of Work accordingly. Late comments will not be considered. Comments must be submitted to Ms. Mischere Kawas, Regional Contracting Office/Budapest, at mkawas@usaid.gov. This is not a formal Request for Proposals. USAID Mission in Kosovo will inform the potential bidders of the Request for Proposals for the CLE Program through a Pre-Solicitation Notice that may be issued in the next couple of months. This notice does not constitute an obligation or endorsement by USAID to proceed with the CLE Program. Any planned undertakings pursuant to CLE are subject to internal approvals and availability of funds. Responses to this request for comment are not binding on the U.S. Government and do not obligate USAID to issue a Solicitation, nor does it commit USAID to pay any cost incurred in the preparation and submission of comments.
