Description
This is not a request for proposal or a request for quote. There is no solicitation document available. This is a notice of intent of the U.S. Department of Veterans Affairs (VA) at Acquisition Service- Frederick to negotiate a sole source contract with Technical Control Consultants, LLC, for Cat 6 Patch Cords. The strategies are in the best interest of the Federal government and the price is fair and reasonable. The statutory authority for this sole source procurement is 41 U.S.C. 253(c)(1) 10 U.S.C. 2304(c)(1). Please reply no later than May 21, 2012 to Selena Robinson @va.gov. JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION 1.Identification of agency and the contracting activity: Acquisition Service Frederick Office of Acquisition Operations (OAO) 8490 Progress Drive, Suite 100 Frederick, MD. 21701 2.Nature and or description of the action: This is proposed sole source procurement for locking Cat 6 patch cords. We currently are using this product in our communications closet renovation project and are the standard to adhere to Continuous Readiness in Information Security Program CRISP requirements. There is one manufacturer and only one distributor of the product at this time, like products will not work as the keys are not interchangeable. It is a firm-fixed price for these materials the suggested vendor is Technical Control Consultants, LLC (TC2) PO Box 915, Bridgeton, N.C. 28519. 3.A description of the supplies or services required to meet the agency's needs (including the estimated value: This is to provide locking Advanced Fiber Products AFP Category 6 patch cords for installation within VACO communications closets. This product enhances our physical security of the network. The total estimated price of the proposed action is $124,665.15 4.An identification of the statutory authority permitting other than full and open competition. The statutory authority permitting other than full and open competition is 41 U.S.C.253(c)(1), 10 U.S.C. 2304(c)(1) as implemented by the Federal Acquisition Regulation (FAR) Subpart 6.302-lentitled, "Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements." 5.A demonstration that the proposed contractor's unique qualifications or the nature of the acquisition requires use of the authority cited. They are the only manufacturer of this product and it is currently in use in our communication closets throughout the campus. We have been directed to provide physical security down to the patch panel and this product fills those requirements. Since it is currently in use across the campus changing to a different product would require additional funds spent replacing the current cables. 6.A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether notice was or will be publicized as required by Subpart 5.2 and, if not, which exception under 5.202 applies. Market research was conducted, details of which are in the market research section of this document. This effort did not yield any additional potential sources who could meet the Government's requirements. There is no competition anticipated for this acquisition. Intent to sole source will be publicized on Fedbizopps. 7. A determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable. Prior market research will be used to determine anticipated cost to the Government. To determine price reasonableness the contract specialist will use price analysis below to determine final analysis prior to award. "Comparison of proposed pricing "Comparison with IGCE "Comparison with Market Research 8.A description of the market research conducted (see Part 10) and the results or a statement of the reason market research was not conducted. There is currently only one supplier of these products TC2, we have recommended to the manufacturer to develop relationships with other telecommunications supply companies. There are other "like" products that are manufactured under other specifications that will not meet our needs, and would require us to replace all existing locking patch cords. 9.Any other facts supporting the use of other than full and open competition: None. 10.A listing of the sources, if any, that expressed, in writing, an interest in the acquisition. World Wide Technology: None. 11.A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required.
