Description
Justification for Other Than Full and Open Competition - Snow/Mist Filter System This Notice of Intent is NOT a Request for Quotation (RFQ) for competitive quotes; however, in accordance with FAR Part 13 and Part 6.302-1, the Federal Emergency Management Agency (FEMA) intends to award a sole source purchase order based on the authority of FAR 6.302-1 "only one responsible source and no other supplies or services will satisfy agency requirements". FEMA intends to award this purchase order to MISTOP (Division of Acme Manufacturing Corp.) for the purchase of a SnoStop® snow/mist filter system, which is considered a commercial item in accordance with FAR Part 2. This action is being performed in accordance with FAR 13.106-1(b)(1) which states, "For purchases not exceeding the simplified acquisition threshold, contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available". A Justification for Other Than Full and Open Competition has been approved by the Contracting Officer and is provided as an attachment to this notice. A comprehensive snow/mist filter system, which will filter as well as melt snow, is needed by FEMA, MWEOC for the continued reliable and safe operation of emergency generators during heavy fog and snow conditions. The snow/mist filter system must be custom designed to meet the requirements specified in the Statement of Work. MISTOP is believed to be the sole source provider of the SnoStop® Snow Eliminator; there are no resellers. FEMA is unaware of other companies capable of providing a snow/mist filter system which both filters and melts snow. However, any company capable of providing an equivalent product may submit descriptive literature, specification sheets, etc., in order to allow the Government to perform an evaluation of your proposed product. This information should be emailed to Phyllis.Woodward@dhs.gov, or by fax to 540-542-2631, no later than May 29, 2012. Capabilities/qualifications will be evaluated solely for the purpose of determining whether or not to conduct this procurement on a competitive basis. A determination not to compete this proposed procurement based on responses to this notice is solely within the discretion of the Government.
