- General Services Administration Greater Chicago-land Service Center 219 South Dearborn Street Chicago, IL 60604 JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION IN ACCORDANCE IN WITH FAR 6.302 Identification of description of action being approved. Approval is requested for other than full and open competition for the acquisition described herein, under the authority of Unusual and Compelling Urgency. Executed on behalf of GSA, for Room 1828 at the E.M. Dirksen U.S. Courthouse, 219 S. Dearborn Street, Chicago, IL. The proposed action involves procuring services to take air, carpet, padding, and seam tape for Volatile Organic Compounds (VOC) and other compounds that could cause odors. The samples are to be taken from room 1828. The analysis of the samples are needed to determine the cause of an unidentified odor. The proposed action will be accomplished pursuant to FAR 6.302-2 due to the unusual and compelling urgency of the life and safety issue of the unidentified odor. 1. FAR 5.202-2(a)(2) does not require that the action be synopsized. 2. 41 U.S.C. 253 (c) (2) permits agency to limit the number of sources from which it solicits bids or proposals. Description of services required. The need exist to take air samples along with carpet and padding samples. The services required include collecting three air samples, one each from the affected room, one for the non-affected area, and one from the exterior outside environment. A 7" x 7" sample of the carpet, carpet padding, and seam tape from the affected room will also be collected. All samples will then be tested at a laboratory to determine whether the compounds found in the carpeting materials match those found in the air samples. The evaluation of the samples found in the compounds will specifically focus on VOC's, aldehydes, and human odor compounds. A determination will then be made as to whether the odor present in room 1828 is the origin of the life and safety (illness). Identification of statutory authority. FAR 6.302-2 Unusual and compelling urgency, 41 U.S.C. 253(c)(2). Demonstration that the acquisition requires use of the authority cited. When the agency's need is of an unusual and compelling urgency that the Government would be seriously injured unless the agency is permitted to limit the number of sources from which it solicits bids or proposals, full and open competition need not be provided for. This acquisition requires the authority cited due to the life safety matter. The tenants have complained of headaches and sickness from the odor present in their area. All building systems (fans, perimeter induction units, plumbing chases, etc) have been investigated with no source of the odor found. Environmental consultant Carnow Conibear was procured to take initial air readings for VOC's. None were found at that time. Analysis of the carpet is needed to determine the exact cause of the odor so that remediation efforts can be performed immediately in order to mitigate the life safety problem present in this office. Description of efforts to solicit as many offers as practicable. Unusual and compelling urgency indicates that an action need not be synopsized if an unusual and compelling urgency precludes competition to the maximum extent practicable and the Government would be seriously injured if the agency complies with the time periods specified. Because the work in question is a life and safety issue, it is cost effective to the Government to use the same contractor that performed the initial air readings. Demonstration that the anticipated cost will be fair and reasonable. GSA has prepared an Independent Government cost Estimate (GCE) to assist in the establishment of a fair and reasonable price. Price is determined fair and reasonable based on the GCE. Description of the market survey conducted. N/A Other facts supporting the use of other than full and open competition. Carnow Conibear's services were previously procured to conduct immediate air sampling for VOC's in the affected area. This contractor has knowledge of this issue and has already been in the affected area. Carnow Conibear would best know the next step needed to resolve this issue. Statement of actions to overcome barriers to competition. The tenants working in this area are experiencing headaches and illness due to the odor present in the affected room. Given the life safety concern of the condition in this area, there are no actions that could be taken to remove or overcome the existing barriers to competition. The need to acquire the stated service in the manner proposed is due to the unusual and compelling urgency of the life safety situation present. The services must be obtained as soon as possible to prevent further harm to the occupants of this office. List of sources that expressed an interest in the acquisition.
