- The U.S. Food and Drug Administration intends to negotiate and award on a sole source basis to Pragmatic Data LLC, under the authority 41 U.S.C. 253(c) (1), as set forth in FAR 6.302-1. This acquisition is in support of the FDA's ELIST system. FDA procured from Pragmatic Data software licenses for Pragmatic Data Integrator and the PRPLLR module. This software is currently used to automatically process files containing drug establishment and drug product information including product labeling. If we didn't have the software, we would be unable to process, review and distribute this information in a timely fashion without significant increases in costs to the FDA. Last year FDA also procured an additional module (Review and Edit Module) to process ingredient and product information generated by FDA. This software would allow FDA to integrate internal data with data obtained from companies to allow more efficient processing, review and distribution of information. If we didn't have the software, the integration of the information would be inefficient and costs would be increased. FDA is procuring an additional module to process adverse event reports. This software would allow FDA to integrate internal data with data obtained from companies to allow more efficient processing, review and distribution of information. Annual maintenance for these licenses is required to continue regulatory operations. Annual maintenance includes product updates, patches, and professional services to support software operations and use of the information processed. Pragmatic Data operations and maintenance services and software coding are currently sold exclusively by Pragmatic Data and there are no resellers. There is no other source that can provide maintenance, release, and software documentation for this software The period of performance for the annual maintenance is one (1) year. The Contractor shall also provide eLIST custom coding which are currently sold exclusively by Pragmatic Data and there are no resellers or 3rd parties that can provide these services. There is no other source that can provide maintenance, release, and software documentation for this software. The Contractor shall provide annual maintenance that includes product updates, patches, and professional services to support the implementation and use of the system. The NAICS code is 541512. This notice of intent is not a request for competitive quotations. However, any firm that believes it can meet these requirements may submit a written response via email to Trevor R. Edwards at the email address below by noon on May 15, 2011. Supporting evidence must be furnished in sufficient detail to demonstrate the ability to comply with the above requirement. Information received will be considered; however, a determination by the Government not to compete the proposed acquisition based on responses to this notice is solely within the discretion of the Government. If no responses are received, the FDA will proceed with the sole source award to Pragmatic Data LLC, 8839 Rexford Road, Indianapolis, IN 46260.
