Description
General Services Administration Greater Chicagoland Service Center 230 S Dearborn, Suite 3150 Chicago, IL 60604 JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION IN ACCORDANCE IN WITH FAR 6.302-1 Sole Source Justification for George Sollitt Construction - Exterior Parking Lot Lights The proposed action involves procuring services for the fire egress road that will surround the entire Federal Archives Facility at 7358 S Pulaski St in Chicago Illinois. The proposed action will be accomplished pursuant to FAR 6.302-1 because of general liability due to insurance and overall cost effectiveness due to site constraints. 1. FAR 5.202(a) (2) does not require that the action be synopsized. 2. 41 U.S.C. 253 (c) (2) permits agency to limit the number of sources from which it solicits bids or proposals. Description of services required. George Sollitt Construction Company shall provide labor and material to wire parking lot lights. Wire tracing and trenching are also part of the scope of work. Work will also ensure that all existing wiring is up to code to prevent future issues. Since the electrical contractor is familiar and has a great knowledge of how the site electrical wiring is done due to previous fixes with the exterior perimeter building lights; and has trenching equipment on site for underground wiring activities. Identification of statutory authority. FAR 6.302-2 unusual and compelling urgency, 41 U.S.C. 253(c)(2). Demonstration that the acquisition requires use of the authority cited. When the agency's need is of an unusual and compelling urgency that the Government would be seriously injured unless the agency is permitted to limit the number of sources from which it solicits bids or proposals, full and open competition need not be provided for. Due to substandard electrical construction, the exterior parking lot lights have shorted out. The exterior parking lot lighting is not working and is dangerous to both the tenants and employees. Not having lighting to light the parking lot is a life and safety issue. It is in the best interest of the Government to contract directly with the electrical contractor currently on site. Description of efforts to solicit as many offers as practicable. Since the work in question is a life and safety issue, it is cost effective to the Government to use the current contractor on site in order to accomplish this work as soon as possible. Time would not permit the solicitation and award of a separate contract due to the life and safety issues presented with loss of exterior parking lights that are used for safety purposes for both the tenants and employees. Demonstration that the anticipated cost will be fair and reasonable. A Government Cost Estimate was prepared for this location, and will be used to determine that the received proposal is fair and reasonable. Description of the market survey conducted. N/A Other facts supporting the use of other than full and open competition. The contractor is currently on location working on an American Recovery Reinvestment Act (ARRA) project. In determining overall competition methods, it is in the best interest of the Government to contract directly with George Sollitt Construction Company. Mobilization costs is zero due to the availability of the contractor being on site; Currently the electrical contractor is on site and has a great knowledge of how the site electrical wiring is done due to previous fixes with the exterior perimeter building lights; and Contractor currently has trenching equipment on site for underground wiring activities. Statement of actions to overcome barriers to competition. Given the unique and unusual circumstances of this situation, there are no actions that could be taken to remove or overcome the existing barriers to competition. The need to acquire the stated service in the manner proposed is due to the need for accomplishing the service in as short a period of time that is practical. List of sources that expressed an interest in the acquisition. One source has been identified as listed below: George Sollitt Construction, 790 N Central Ave., Wooddale, IL 60191 CONTRACTING OFFICER CERTIFICATION : I hereby certify that the above information is accurate and complete to the best of my knowledge. Agency requirements supporting this justification for other than full and open competition for the procurement build a fire egress path at the Federal Archives Facility is accurate.
