Description
NOTICE OF PROPOSED CONTRACT ACTION (NOPCA): The Cryptologic Systems Division (CPSD) Contracting Branch, HNCKA, Lackland AFB, San Antonio, TX, intends to award on a sole source basis a firm-fixed-price contract for procurement of MYK5/12 Tester Boards, 4 each. The MYK5/12 Tester Boards are required to meet lifecycle sustainment for the next 20 years. The tester boards were developed by the Original Equipment Manufacturer (OEM), SafeNet Government Solutions, LLC, 359 Van Ness Way, Torrance, CA 90501, CAGE CODE: 6S598, as a propriety product and received National Security Agency (NSA) certification as a Type-1 CRYPTO unit under the NSA Commercial COMSEC Endorsement Program (CCEP). The proposed contract action is for supplies for which the government intends to solicit and negotiate with only one source IAW 10 U.S.C. 2304(c)(1) as implemented by FAR 6.302-1, only one (1) responsible source. The Air Force's lack of complete specifications, schematics/drawings and parts precludes the use of Full and Open Competition procedures to satisfy this requirement. SafeNet is the only vendor known to the Air Force capable providing these tester boards, because as the OEM it has the required software to make the circuit board work to test MYK-5/12 ground units, to include the engineering knowledge, expertise, and complete drawing package related to the MYK5/12 ground units. An ESD Ombudsman has been appointed to consider and facilitate the resolution of concerns from offerors, potential offerrors, and others for this acquisition. Before consulting the Ombudsman, concerned parties should first address their concerns, issues, disagreements, and/or recommendations to the Contracting Officer for consideration. IAW AFFARS 5352.201-9101, the ability to contact an Ombudsman, will be included in this acquisition's solicitation and contract.
