- The Commodity Futures Trading Commission ("CFTC" or "Commission") intends to award a sole source contract to Dr. James Moser, formerly Deputy Chief Economist for the Commodity Futures Trading Commission, for consulting services to CFTC. Prior to his retirement on March 30, 2012, Dr. Moser led initiatives where quantitative analyses were used to detect violations of Sections 6(c), 6(d), and 9(a)(2) of the Commodity Exchange Act, 7 U.S.C. § 9, 13(b) and 13(a)(2) (2006), which make it unlawful for any person to attempt to manipulate the market of any commodity in interstate commerce, or for future delivery on or subject to the rules of any registered entity, including any contract market. Dr. Moser's research agenda focuses on three questions: What is the contribution of derivatives to the real economy? What arrangements do private markets make to resolve problems arising from use of derivatives? And, what is the proper role of government in regulating derivatives activity? He has devoted a significant amount of time and effort in building expertise in the trading of derivatives through research and discussion with major industry participants and providers. His previous industry positions were at the Federal Reserve Bank of Chicago as a Research Officer and at the Chicago Mercantile Exchange where he was a Senior Director. He has held academic positions at Louisiana Tech, Michigan State University and the University of Kentucky. He received his BS in Economics from Virginia Commonwealth University in 1978 and Ph.D. in Finance from Ohio State in 1986. Dr. Moser's knowledge, experience, and personal contacts are not easily replaced, nor are individuals with this knowledge generally available to the Commission. His ability to communicate with both technical experts and Commission policy makers concerning technical matters is both a rare and an essential skill, and together with his knowledge of ongoing matters at the Commission, his qualifications are irreplaceable in the near term. CFTC anticipates awarding a one-year contract using FAR Part 12 and Part 13 procedures for these services. This notice does not constitute a solicitation for offers and, as such, no solicitation is available. However, the Government will consider responses from all responsible sources received by the response date and time identified in this synopsis. Written responses must include sufficient information to establish capability to fulfill the requirement. Any responses received will only be considered for the purpose of determining whether to conduct a competitive procurement in lieu of the sole source contract described in this notice, and such determination shall be made at the sole discretion of CFTC.
