Description
This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6 of the Federal Acquisition Regulations (FAR), as supplemented with additional information included in this notice. Offers are being requested and a written solicitation will not be issued. This opportunity is a 100% small business set aside and NAICS 324110 size standards applied (1,500 Employees/125,000 Barrels). The contract resulting from this procurement will be a firm fixed price simplified acquisition order. The solicitation HSFE50-12-Q-0031 is issued as a Request for Quotation (RFQ), under the Simplified Acquisition Procedures (SAP), Part 13. This document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-57 dated 15 March 2012 and 2005-56 dated April 2, 2012. The clauses and provisions referenced in this solicitation may be reviewed/obtained in full text form at http://farsite.hill.af.mil/vffara.htm. Scope of Contract: The contractor shall provide 4,000 gallons of high sulfur fuel oil burner #2 (off-road diesel fuel), (Reference NSN: 9140-00-247-4365, product code (FS2)) delivered to 65 Old Marlboro Rd, Maynard, MA. 01754. Offerors shall be located within 40 miles of Maynard, MA. Required Delivery Date is 7 business days ARO, FOB Destination and shall be made between the hours of 8 A.M. and 2 P.M. weekdays (M-F). The vendor shall not deliver any more fuel than is listed on this contract. If the vendor does, then the vendor proceeds at own risk and will not be compensated for additional deliveries. The resultant award is subject to change in order to increase the number of gallons ordered beyond the stated limit and said increase shall be by a bilateral agreement. Market pricing will be utilized for any gallons added and a modification will only occur if it is determined to be in the best interest of the government. Any modification (s) will be subject to all applicable provisions and clauses contained in the original award. The modification (s) will be subject to all appropriation laws and availability of funds. The following provisions and clauses apply to this acquisition: FAR 52-212-1, Instructions to Offerors Commercial Items; 52.212-3 Offeror Representations and Certifications Commercial Items; 52.212-4, Contract Terms and Conditions Commercial Items and 52.212-5 Contract Terms and Conditions Required to Implement Statutes or Executive orders - Commercial Items. In paragraph (b) of 52.212-5, the following apply: FAR 52.203-6; 52.219-6, 28; 52.222-3, 19, 21, 26, 50; 52.223-18; 52.225-5, 13; 52.232-33. Also FAR 52.225-25 Prohibition on Contracting with Entities Engaging in Sanctioned Activities Relating to Iran-Representation and Certification; 52.232-18 Availability of Funds and 52.233-4 Applicable Law for Breach of Contract Claim shall be applicable. Evaluation Factors: price, location of vendor to location of delivery, past performance. Offerors shall include a completed copy of the provision at 52.212-3, Offeror Representations and Certifications - Commercial Items with its offer.
