- This is a combined synopsis/solicitation for commercial items prepared in accordance with FAR Part 13 Simplified Acquisition Procedures, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. The solicitation HSCG23-12-Q-QRX195 is issued as a request for quotation (RFQ). The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-57. This acquisition is a small business set-aside for the associated NAICS codes 334511 and 334519 with a small business size standard of 500 employees. The USCG requires the following items and quantities: Description: Standard CT-30 Contraband Inspection/Detection Kit Quantity: 2 Unit: Each Unit Price: ____________ Extended Price: ________________ Delivered FOB destination to: United States Coast Guard Maritime Law Enforcement Academy 2000 Bainbridge Ave Charleston, SC 29405 The POC for delivery is: SKC Phyllis Thomas Supply Chief 843-740-6616 Delivery is required within 60 days after award. Applicable Clauses: The provision at 52.212-1, Instructions to Offerors-Commercial and is supplemented as follows: Quoters shall submit the following in order to be considered for award: 1. Technical Capability to meet the requirements of the Government- Quoters shall submit a complete list and description of every item included in the CT-30 Contraband Inspection/Detection Kit that they are offering. 2. Price - Quoters shall submit their price FOB Destination for the required supplies listed above including unit price and total price. 3. PAST PERFORMANCE - Provide contract numbers and government points of contact for (3) similar efforts performed within the last two years. Quote Submission Deadline: Vendors shall submit an electronic version of their quote in word or adobe pdf format by 3:00 PM ET on March 30, 2012 via email to Devin Fitzpatrick at Devin.j.fitzpatrick@uscg.mil. The provision at 52.212-2, Evaluation-Commercial Items. To be included in paragraph (a) of that provision: The USCG intends to award a purchase order to the company whose quote represents the best value to the Government. The evaluation shall consider the quoters response to each of the following evaluation factors in no order of importance: 1. Technical Capability to meet the requirements of the Government 2. Price 3. Past Performance. Offerors will include a completed copy of the provision at 52.212-3, Offeror Representations and Certifications-Commercial Items, with its offer. Quotes shall include pricing for each item listed above inclusive of all shipping, handling, and any warranties. Delivery will be FOB Destination. Quotes shall include a complete description of the warranty provided in the price. All clauses will be incorporated by reference in the order. Central Contractor Registration (CCR). Quoters must be registered in the CCR database to be considered for award. Registration is free and can be completed on-line at http://www.ccr.gov/. All quotes shall include price(s), a point of contact, name and phone number, business size, and payment terms. Each response must clearly indicate Delivery time frame. Coast Guard Acquisition Procedures (CGAP) APPENDIX C - CHAPTER 3033 NOTICE FOR FILING AGENCY PROTESTS United States Coast Guard Ombudsman Program It is the policy of the United States Coast Guard (USCG) to issue solicitations and make contract awards in a fair and timely manner. The Ombudsman Program for Agency Protests (OPAP) was established to investigate agency protest issues and resolve them without expensive and time-consuming litigation. OPAP is an independent reviewing authority that is empowered to grant a prevailing protester essentially the same relief as the Government Accountability Office (GAO). Interested parties are encouraged to seek resolution of their concerns within the USCG as an Alternative Dispute Resolution (ADR) forum rather than filing a protest with the GAO or some external forum. Interested parties may seek resolution of their concerns informally or opt to file a formal agency protest with the Contracting Officer or Ombudsman. Informal Forum with the Ombudsman. Interested parties who believe a specific USCG procurement is unfair or otherwise defective should first direct their concerns to the applicable Contracting Officer. If the Contracting Officer is unable to satisfy their concerns, interested parties are encouraged to contact the U.S. Coast Guard Ombudsman for Agency Protests. Under this informal process the agency is not required to suspend contract award performance. Use of an informal forum does not suspend any time requirement for filing a protest with the agency or other forum. In order to ensure a timely response, interested parties should provide the following information to the Ombudsman: solicitation/contract number, contracting office, Contracting Officer, and solicitation closing date (if applicable). Formal Agency Protest with the Ombudsman. Prior to submitting a formal agency protest, protesters must first use their best efforts to resolve their concerns with the Contracting Officer through open and frank discussions. If the protester's concerns are unresolved, an Independent Review is available by the Ombudsman. The protester may file a formal agency protest to either the Contracting Officer or as an alternative to that, the Ombudsman under the OPAP program. Contract award or performance will be suspended during the protest period unless contract award or performance is justified, in writing, for urgent and compelling reasons or is determined in writing to be in the best interest of the Government. The agency's goal is to resolve protests in less than 35 calendar days from the date of filing. Protests shall include the information set forth in FAR 33.103(d) (2). If the protester fails to submit the required information, resolution of the protest may be delayed or the protest may be dismissed. To be timely protests must be filed within the period specified in FAR 33.103(e).
